The Prime Minister has just issued Decision No. 759/QD-TTg approving the Project to rearrange and reorganize administrative units at all levels and build a model of organizing local government at 2 levels, which clearly states the staffing of cadres, civil servants and public employees (CBCCVC) at the commune level.
The Government assigned the Ministry of Home Affairs to coordinate with the Central Organizing Committee and relevant agencies based on the population size, natural area, functions, tasks, and time limits of local authorities at the commune level as a basis for developing and completing job positions to submit to competent authorities to assign the staffing of civil servants and public employees at the commune level to localities.
Notably, based on the population size, natural area, and socio-economic development level of commune-level administrative units, the Government aims to assign the total number of local government positions at the commune level to localities (expected to average about 32 positions/01 at the commune level).
On that basis, the local government at the provincial level is assigned to decide on the number of staff for each commune-level administrative unit in the area to suit practical requirements.
In the immediate future, due to the larger size of the administrative unit of the commune and the duties and powers of the local government increases, the Government oriented the number of cadres and civil servants of the district level and officials and civil servants of the existing commune level to arrange to arrange for new administrative units at the new commune level (after arranging).
However, Decision No. 759/QD-TTg requires the implementation of reviewing and streamlining the payroll in conjunction with restructuring and improving the quality of the commune-level civil servants and public employees to meet the requirements of the tasks, ensuring a period of 5 years basically in accordance with regulations.
Previously, based on Article 2 of Decree 178/2024/ND-CP amended by Clause 2, Article 1 of Decree 67/2025/ND-CP, the subjects for staff streamlining include:
- civil servants, public employees, people working under labor contracts in agencies, organizations, and units specified in Article 1 of Decree 178/2024/ND-CP and armed forces are directly affected by the implementation of organizational restructuring and administrative unit restructuring at all levels.
- CBCCVC, employee who earns salary from the state budget in accordance with the law before January 15, 2019 and the armed forces still have 5 years or less to retirement age in agencies, organizations and units prescribed in Article 1 of Decree 178/2024/ND-CP does not bear the direct impact of the organizational structure of the apparatus but must streamline the quality of the staff.
- People working within the staffing quota and receiving salaries from the state budget at associations assigned by the Party and the State at the central, provincial and district levels are directly affected by the implementation of organizational arrangement, consolidation and consolidation.
- Officers who are not old enough to re-election and re-appointment specified in Clauses 1, 2 and 3, Article 2 of Decree 177/2024/ND-CP stipulating regimes and policies for cases of non-re-election and re-appointment; Officials who are eligible for the age of re-election and re-appointment of the party committee of the same level, have a working period from the beginning of the meeting to organize the Congress from 2.5 years (30 months) to 5 years (60 months) to the retirement age as prescribed in Clause 4, Article 2 of Decree 177/2024/ND-CP and cadres who are participating in the Party committees at the Party committees must end the operation, consolidate the organization of the retirement to the age of retirement to the age of retirement. Conditions for arranging personnel at the Party Congress at all levels to go to the XIV National Congress of the Party and agreed by the competent authorities.
