This is one of the notable proposals proposed by the Ministry of Public Security in the draft Decree amending and supplementing a number of articles of Decree 144/2021/ND-CP regulating administrative sanctions for violations in the fields of security, order, and social safety; prevention and control of social evils; fire prevention and fighting; rescue; and prevention and control of domestic violence.
According to a study by Lao Dong reporter on November 12, the draft decree proposes to amend the regulations on fines for violations in the issuance, management and use of citizen identification cards, identification cards or electronic identification cards. This is to comply with the new Identification Law.
Accordingly, the draft decree proposes a fine of 4-6 million VND for the act of forging citizen identification cards, identification cards, electronic identification cards, identification certificates, 9-digit identity card information confirmation papers with personal identification numbers, and canceled personal identification number confirmation papers with re-established personal identification numbers but without being prosecuted for criminal liability.
Using fake citizen identification cards, fake identification cards, fake electronic identification cards, fake identification certificates, 9-digit identity card information confirmation papers with personal identification numbers, canceled personal identification number confirmation papers with fake re-established personal identification numbers.
Mortgage, pledge, accept pledge of citizen identification card, identity card or identity certificate.
Buying, selling, renting, leasing citizen identification cards, identification cards or identity certificates. Borrowing, lending citizen identification cards, identification cards or identity certificates to commit acts contrary to the provisions of law.
According to the draft decree, the above fines apply to administrative violations committed by individuals. Organizations committing the same violation will be fined twice the fine for individuals.
