The Ministry of Justice is reviewing the draft Decree regulating the duties, powers, organization and operation of the People's Committee, Chairman of the People's Committee, professional agencies, and other administrative organizations under the People's Committee of the special zone in special cases. The draft Decree was drafted by the Ministry of Home Affairs.
The Ministry of Home Affairs said that the promulgation of this Decree is urgent and necessary to promptly institutionalize the Party's policies in the Resolutions and Conclusions of the Central Committee, the Politburo, and the Secretariat on the arrangement of administrative units and appointment of local government at 2 levels; based on the provisions of Clause 2, Article 28 of the Law on Organization of Local Government; promptly create a legal basis for the organization and operation of local government in special zones with a permanent population of less than 1,000 people (hereinafter referred to as special zones).
One of the notable contents proposed by the Ministry of Home Affairs in the draft Decree is the working relationship between the People's Committee of the Special Zone, the Chairman of the Special Zone with the People's Committee at the provincial level, and the Chairman of the People's Committee at the provincial level.
Accordingly, the People's Committee of the special zone is directly led and directed by the Provincial People's Committee, complies with the inspection and complies with the professional guidance of specialized agencies under the Provincial People's Committee in performing tasks in the special zone; implements the reporting regime to the Provincial People's Committee according to regulations.
The Chairman of the People's Committee of the Special Zone is under the direct leadership and direction of the Chairman of the Provincial People's Committee. When encountering issues beyond their authority, the Chairman of the Special Zone must report to the Chairman of the Provincial People's Committee for direction, except in cases where it is necessary for national interests, ensuring security and sovereignty of islands, preventing and combating natural disasters and epidemics, ensuring the lives and property of people in the special zone, then decide to apply other urgent measures prescribed by law or exceeding their authority, then report to the competent authority of the Party and the Chairman of the Provincial People's Committee as soon as possible.
In addition, the working relationship between the People's Committee of the special zone and the Provincial People's Council was also clearly stated.
The People's Committee of the special zone is under the supervision of the Provincial People's Council during its activities, performing its tasks and powers; complying with the Constitution, laws, and implementing the resolutions of the Provincial People's Council.
Quarterly, report the results of activities to the Provincial People's Council or make an ad hoc report as requested by the Provincial People's Council. The Chairman of the People's Committee of the Special Zone is responsible for explaining related issues to the Provincial People's Council when requested.
