This is the content stated in the draft Decree on determining the authority of the internal affairs sector when organizing local governments at two levels. The draft is chaired by the Ministry of Home Affairs and is being appraised by the Ministry of Justice.
In the draft, the Ministry of Home Affairs clearly states the principles of decentralizing authority and implementing the direction of the Steering Committee, the draft decentralizes authority in the direction of:
The commune level mainly implements policies issued by the central and provincial levels, focusing on tasks of serving the people, directly solving the problems of the community, providing basic and essential public services to the people in the area.
The new commune-level government assumes the tasks and powers of the local government at the commune level and the tasks and powers of the current district-level local government.
Provincial authorities will manage, inspect and supervise the activities of local authorities at the commune level.
In the draft Decree, the Ministry of Home Affairs proposes to stipulate the recognition of war invalids in the current police force.
Accordingly, the injured person, as prescribed in Clause 1, Article 80 of Decree 131/2021, must prepare a declaration according to Form No. 03 of this Decree and, depending on each case, attach the following documents to the Commune-level Police:
In the case specified in Point a, Clause 2, Article 76 of Decree 131/2021, attach documents and papers proving the injury.
In the case specified in Point b, Clause 2, Article 76 of Decree 131/2021, the results of filming and the results of the district-level hospital or district-level medical center or equivalent or higher (including military and police hospitals) shall be attached.
If the foreign body has been surgically removed, it must be accompanied by a surgical certificate or a paper or a summary of the hospital's records recording this content.
Notably, the Chairman of the Commune People's Committee issued certificates of injury for cases under his authority; transferred the entire dossier to the Department of Home Affairs to submit to the Chairman of the Provincial People's Committee with an official dispatch requesting the Ministry of Home Affairs for appraisal.
