This is the content stated in the draft Decree on determining the authority of the internal affairs sector when organizing local governments at two levels. The draft is chaired by the Ministry of Home Affairs and is being appraised by the Ministry of Justice.
According to the submission, the Ministry of Home Affairs said that this draft decree stipulates the division of authority in internal affairs when organizing two-level local governments; the order and procedures for implementing administrative procedures when determining authority from district-level authority to commune-level and provincial level.
The draft Decree consists of 6 Articles and 1 Appendix. The Appendix of the draft Decree amending, supplementing and abolishing 149 is stipulated in 23 documents, including:
Remove content related to district-level government: 66 contents in the fields of employment - labor safety, emulation and rewards, non-governmental organizations, meritorious people, cadre organizations, youth and gender equality;
Transfer tasks from district-level agencies and organizations to regional levels to comply with the organizational model of agencies, organizations and units: 1 content in the field of salary - social insurance;
The task of state management from the district level transferred the commune level: 60 contents in the field of emulation and commendation, the field of salary - social insurance, employment field, labor safety, the field of personnel, youth field and gender equality, the field of non -governmental organization, the field of people with meritorious services;
State management tasks from the district level to the provincial level: 22 contents in the field of documentation and state archives, the field of emulation and rewards, the field of salary - social insurance, the field of employment, labor safety, youth and gender equality, meritorious people.
Notably, in the field of emulation and commendation, the Ministry of Home Affairs proposed to abolish Clause 2, Article 80 of the Law on Emulation and Commendation: The Chairman of the District People's Committee decides to award the title of village or cultural residential group, "Advanced labor collective", "Emulation fighter at the grassroots level", "Advanced laborers" and certificates of merit.
Instead, the Ministry of Home Affairs proposed to amend and supplement Clause 3, Article 80 of the Law on Emulation and Commendation: The Chairman of the People's Committee at the commune level decides to award the title of village or cultural residential group, "Cultural Family", "Advanced Labor Collective", "Emulation Fighter at the grassroots level", "Advanced Worker" and certificates of merit.
Currently, Clause 3, Article 80 of the Law on Emulation and Commendation stipulates that the Chairman of the People's Committee at the commune level decides to award the title of "Advanced Worker", certificate of merit and the title of "Cultural Family".
