Tomorrow (September 28), the National Assembly Standing Committee will give its opinion on the draft Law on Organization of Local Government (amended).
Before submitting to the National Assembly Standing Committee for comments, this draft Law was also discussed and consulted at many sessions.
At the second plenary session on the draft Law, through discussion, the majority of members of the Law and Justice Committee agreed to the fundamental and comprehensive amendment of the current Law, and at the same time agreed to develop a draft Law according to a shortened order and procedure.
Based on the two-level local government, Deputy Minister of Home Affairs Truong Hai Long said that the draft Law amends regulations on promoting decentralization and delegation of authority and clearly defines the tasks and powers of the provincial and commune levels.
Accordingly, the draft Law clearly defines the tasks and powers of each level of local government in the direction of the provincial level focusing on issuing mechanisms, policies, strategies, planning, and macro management, issues of inter-regional and inter-commune nature, exceeding the settlement capacity of the commune level, requiring in-depth expertise and ensuring consistency at the whole provincial level.
The commune level is the organization of policies (from the central and the provincial level), focusing on the tasks to serve the people, directly solve problems of the community, provide basic and essential public services to people in the area; The tasks need the participation of the community, promote the initiative and creativity of the commune level.
According to the Deputy Minister of Home Affairs, the draft Law also amends and supplements regulations on the organization of the apparatus of local governments and has regulations to resolve arising issues related to the conversion of the local government model from 3 levels to 2 levels.
According to the draft report of the project, the Standing Committee of the Law, the Standing Committee of the Legal and Judiciary Committee agreed on the basic and comprehensive amendment of the Law on Organization of the current local government, and at the same time agreed on the construction of the law project in the order and procedures.
In addition, the Standing Committee of the Committee also basically agrees with the adjustment of tasks and powers of the provincial and commune levels when not organized at the district level.
Regarding this issue, according to the verification agency, the Draft Law stipulates the direction of assigning local authorities to perform the duties and powers of the local and commune -level local authorities; At the same time, adding a number of regulations to promote decentralization from the central level to the provincial level.
Regarding the organizational structure of the People's Committee of the commune, the Standing Committee of the Committee said that the organization of specialized agencies and other administrative organizations to advise and help the People's Committee of the commune is necessary and in accordance with the conclusions and directions of the competent authorities.
However, the verification agency requested the drafting agency to note that the establishment of a specialized department should base on the requirements, workloads and minimum payrolls established and the maximum number of deputy leaders to avoid the division of organization and apparatus, the number of leaders more than the number of public employees directly redundant.
