Decision 727 of the Ministry of Home Affairs announces internal administrative procedures between new State administrative agencies, amended, supplemented and abolished in the field of civil servants and public employees under the management of the Ministry of Home Affairs, effective from July 2025.
In this decision, the Ministry of Home Affairs stipulates that the procedure for temporary suspension of work for civil servants shall be carried out within a maximum of 4 working days from the date of determination of a basis for temporary suspension of work:
The Ministry of Home Affairs also clearly stipulates 7 cases where civil servants may be temporarily suspended from work:
Violations of moral qualities and lifestyle have caused negative impacts, public outrage, and negatively affected the reputation of organizations and individuals.
Performing harassment, negativity, causing trouble for people, businesses, agencies, and organizations during the performance of official duties.
Civil servants deliberately delay, push, avoid responsibility, and do not perform work under their authority according to assigned functions and tasks.
Civil servants who are being considered and disciplined but intentionally do not comply with the requirements of competent authorities during the process of reviewing and handling their own violations or take advantage of their position, power, and influence, or those of others to influence, making it difficult to review and handle, or if they are allowed to continue working, it can be difficult to review and handle discipline.
Civil servants have been subject to party discipline and are currently waiting for consideration and handling of government positions, which if they continue to work will negatively affect the operations of agencies, organizations and units.
There is a document requesting a temporary suspension of work of the inspection, examination, auditing agency, the prosecution agency or another competent agency.
Other cases as prescribed by law or at the request of a competent authority.
The procedure for temporary suspension of work will be appointed and managed by the head of the competent authority; the head of the agency, organization, or unit employing the civil servant.
The Ministry of Home Affairs stipulates that no later than 2 working days from the date of determination of a basis for temporary suspension, the agency, the agency, the organization consulting department, and the staff are responsible for reporting and proposing to the head to issue a decision on temporary suspension.
No later than 2 working days from the date of receipt of a proposal from the agency or department advising on the organization, cadres, and head of the decision to temporarily suspend civil servants from work.
