On December 16, Ho Chi Minh City Party Secretary Tran Luu Quang and the 15th National Assembly Delegation, unit No. 12, had a meeting with voters in Di An ward and Dong Hoa ward (formerly in Binh Duong province) after the 10th session of the 15th National Assembly.
At the meeting, voter Do Bao Hien (Dong Hoa ward) reflected on Residential Area 710 approved in 2001. People have lived there for more than 20 years but have not yet been granted a land use right certificate, directly affecting their rights and life.
Residential area 710, located next to Ho Chi Minh City National University, was previously approved by the People's Committee of Binh Duong province for the policy of building houses for officers and employees of Traffic Construction Company 710 (now Traffic Construction Joint Stock Company 710).
However, the project has not completed legal procedures and has not fulfilled financial obligations, but the company has divided the land to officers and workers, leading to many violations. In 2018, the Investigation Agency of Binh Duong Provincial Police initiated a case related to the management and use of State assets causing loss and waste.
During the investigation, the two leaders involved died in 2021, causing the investigation agency to suspend the case. Up to now, residents of Residential Area 710 have not been granted red books.
Chairman of Dong Hoa Ward People's Committee Vo Trong Tai said that the ward has sent a document to the Ho Chi Minh City People's Committee, Department of Agriculture and Environment, Ho Chi Minh City Police to ask for opinions and request to provide investigation results related to the case; at the same time, the ward proposed the Department of Agriculture and Environment to guide the process of handing over land to the locality, thereby carrying out procedures for granting land use right certificates to the people.
Regarding this issue, Ho Chi Minh City Party Secretary Tran Luu Quang requested the authorities to comprehensively inspect the incident. The principle of resolution is to clarify the responsibilities of the investigation agency and require people to fulfill financial obligations according to regulations. Other conditions related to planning will be considered on a case-by-case basis.
Mr. Tran Luu Quang affirmed that the incident "had a way out" and assigned the Office of the National Assembly Delegation and the Ho Chi Minh City People's Council to synthesize and forward the opinions of National Assembly deputies to the investigation agency.
Voter Tran Thi Quynh Mai (Di An ward) is concerned about the division of plots under the Land Law sometimes having to meet the minimum area and road, which can easily cause problems. Voters recommend having a suitable mechanism for cases where land is left by grandparents and parents for children to live on, ensuring legitimate housing needs.
Regarding this, the Ho Chi Minh City Secretary emphasized that the solution must comply with the law, with the approach being a comprehensive review, fair adjustment, ensuring infrastructure and urban standards, not allowing the situation of going by boat or climbing fences.
Mr. Tran Luu Quang also highly appreciated the model of "Special Cases Consideration Council" that Binh Duong province previously implemented. According to him, the law is universal but cannot cover all cases, especially in rapidly developing localities such as Ho Chi Minh City, Binh Duong or Ba Ria - Vung Tau before.
Therefore, the Secretary of the Ho Chi Minh City Party Committee suggested that the Department of Agriculture and Environment study and propose the establishment of a similar council to resolve specific cases.
Mr. Tran Luu Quang added that Ho Chi Minh City has now issued a new resolution on amending and supplementing Resolution 98, which will be applied to handle special local issues. However, due to the expansion of the area and differences in regimes and policies between previous regions, unification and synchronization need more time.
