On the afternoon of March 25, the National Assembly Delegation Conference (NAD) on specialties discussed the draft Law on Teachers.
The majority of National Assembly deputies agreed with the Report on explanation, acceptance and revision of the draft Law on Teachers; said that the comments had been accepted, explained and fully reflected in the draft Law.
Many opinions said that the reception and revision of the draft Law demonstrates the spirit of innovation in thinking in legislative work, only regulating the contents and policies under the authority of the National Assembly, which have been proven to be stable in practice.
Commenting at the conference, National Assembly Delegate Hoang Van Cuong (Hanoi delegation) was concerned about the regulation prohibiting "forcing learners to participate in extra classes in any form" in the draft Law.
According to delegate Hoang Van Cuong, in reality, not all the time forcing students to take extra classes is bad. Because some teachers see some students being weak in their studies and unable to keep up with their friends in class, they will ask students to stay at the end of the class to study more, and give them more instructions.
In this situation, there are students who are not willing to stay, so they often need to be forced.
"This act of forcing extra classes is not bad, on the contrary, it is very humane and quite common with responsible teachers. So why should we ban it?" - delegate Hoang Van Cuong stated and suggested that it should only be banned from forcing extra classes for the purpose of making a profit, to collect money, and if not for profit, it would be very good, there is nothing to ban.
At the same time, it is necessary to consider the fact that many teachers organize extra classes and force students to go to school, but students and their families have a voluntary petition.
In fact, it is not voluntary but forced in disguise. Therefore, if the regulation is to prohibit compulsory, the situation of voluntary application for extra classes will still occur.
At the discussion session, Vice Chairwoman of the National Assembly Nguyen Thi Thanh said that recently, the Ministry of Education and Training issued Circular 29 regulating extra teaching and learning.
The Ministry needs to soon report and summarize the implementation to stipulate in the law the principles on this issue and not too detailed and specific.
Therefore, Vice Chairwoman of the National Assembly Nguyen Thi Thanh suggested that the Ministry of Education and Training study further the issue of extra teaching and learning.
Article 4, Circular 29/2024 issued by the Ministry of Education and Training clearly stipulates the cases where teachers are not allowed to teach extra classes, including:
Additional teaching for primary school students except for training in arts, sports and life skills.
Teachers are not allowed to teach extra classes outside or collect money from their own students who are teaching at school.
Public teachers are not allowed to participate in managing and operating extra teaching outside of school, but can still participate in extra teaching outside of school.
Based on the above content, if the participants are primary school students or primary school students, teachers are not allowed to teach extra students at home with money, even if the student voluntarily writes an application for extra classes.
For extra teaching and learning activities outside of school, Article 6, Circular 29/2024 stipulates each specific case and requires full implementation.
Accordingly, organizations or individuals organizing extracurricular activities and extracurricular activities outside of school that collect money from students must register for business in accordance with the provisions of law.
At the same time, it is necessary to publicize the subjects for organizing extra classes; the duration of extra classes for each subject according to each grade; location, form, time for organizing extra classes; list of teachers and the tuition fee before enrolling in extra classes.
Extra teachers outside of school must ensure good moral qualities and professional capacity suitable for the subjects they teach.
When participating in extra teaching outside of school, teachers must report to the Principal, Director or head of the school about the subject, location, form, and time of participation in extra teaching.
