Based on the results of the consultation, the Government has proposed to accept and revise the draft Resolution amending and supplementing a number of articles of the 2013 Constitution.
On the Vietnam Fatherland Front and socio-political organizations (content of amending and supplementing Article 9 of the 2013 Constitution)
The majority of opinions agreed with the draft Resolution stipulating that "Vietnam Trade Union, Vietnam Farmers' Union, Ho Chi Minh Communist Youth Union, Vietnam Women's Union, Vietnam Veterans' Association are socio-political organizations under the Vietnam Fatherland Front (VFF)." In addition, some opinions suggested adding the phrase "member" before the word "affiliated".
The Government agreed with the vast majority of opinions with the draft resolution, this is also the opinion of the Central Committee of the Vietnam Fatherland Front and the Draft Committee to amend and supplement a number of articles of the 2013 Constitution.
On Vietnam Trade Union (content of amending and supplementing Article 10 of the 2013 Constitution)
The Government basically agreed with the content of amending Article 10 of the Constitution in the draft Resolution, inheriting the rationality of the Constitutions in recognizing the position and role of the Trade Union organization, while ensuring consistent with the provisions of Article 4 of the 2013 Constitution and the content of amendments and supplements to Article 9 of the above -mentioned Constitution as well as in accordance with the Trade Union organization after the arrangement. Accordingly, the Vietnamese Trade Union is the socio -political organization of the working class and the employees, under the Vietnam Fatherland Front.
However, there is an opinion that it should be affirmed, emphasizing that the Vietnamese Trade Union is "the only representative of workers at the national level in labor relations" and "the only representative of workers in international relations". The addition of the "unique" phrase in Article 10 of the Constitution is necessary "to ensure consistent with the position and role of trade unions.
The government basically agreed with this proposal, this is also the opinion of the National Assembly Party Committee in Report No. 45-BC/DQH. However, the Government suggested that the optimal technical expression should be selected to ensure the Party's views and orientations, and take into account the factors that may be disadvantage in international relations. At the same time, it is necessary to carefully evaluate the impact of this provision, especially in international relations to have appropriate legal and diplomatic political solutions, without affecting Vietnam's investment, economic development and image on the international arena.
Regarding the right to submit draft laws and draft laws of socio-political organizations (content of amendments and supplements to Clause 1, Article 84 of the 2013 Constitution):
The draft Resolution amended and supplemented Clause 1, Article 84 in the direction of only providing for the right to submit to the Law on the National Assembly, submitting to the Ordinance Project to the National Assembly Standing Committee of the Central Committee of Vietnam Fatherland Front without continuing this right to the central agencies of the member organization of the Front. However, agreed with many opinions of the ministries, branches, localities and the Government that the submission of the law project and the Ordinance Project shows the democratic rights of socio -political organizations, so it should be expanded.
Therefore, the Government proposes to stipulate that the central agencies of socio -political organizations have the right to submit to the law project before the National Assembly and submit it to the Ordinance Project to the Standing Committee of the National Assembly. Accordingly, the proposal to amend and supplement the phrase "central agency of the member organizations of the Front" in Clause 1, Article 84 of the 2013 Constitution into the "central agency of political and socio -political organizations".
Regarding the organization of administrative units (content of amending and supplementing Article 110 of the 2013 Constitution):
The Government agreed with the content of amending and supplementing Article 110 of the Constitution in the draft Resolution to institutionalize the policy of streamlining the organization and apparatus of the political system according to Resolution No. 60-NQ/TW.
However, the Government proposed to keep the prescribed in Clause 2, Article 110 of the 2013 Constitution on "The establishment, dissolution, import, division and adjustment of the administrative unit boundaries must collect opinions of the local people and according to the order and procedures prescribed by law" to ensure the people's ownership of the people, the basis for people to discuss publicly and democratically related contents directly to the people.
In addition, the Government has made a number of proposals on the right to question the Chief Justice of the People's Court, the Chief Prosecutor of the People's Procuracy; on legislative techniques and other contents.
