The Ministry of Home Affairs is seeking opinions on the draft Law amending and supplementing a number of articles of the Law on Emulation and Commendation No. 06/2022/QH15.
The Ministry of Home Affairs said that Clause 2, Article 83 of the Law on Emulation and Commendation for 2022 stipulates: The Director of the National University... recognizes achievements, proposes that the Prime Minister submit to the President to award medals, medals, Ho Chi Minh Awards, State Awards, and state honorary titles.
Clause 4, Article 83 of the Law on Emulation and Commendation 2022 stipulates: The Director of the National University... proposes that the Government consider awarding the Emulation Flag of the Government; proposes that the Prime Minister consider awarding the Prime Minister's Certificate of Merit, the title of National Emulation Fighter.
The above regulation is to comply with the position and functions of the National University at the time the Law on Emulation and Commendation was issued in 2022 (a unit established by the Prime Minister; not a unit under the state management of the Ministry of Education and Training; Director and Deputy Director of the National University appointed by the Prime Minister).
However, implementing the organizational arrangement according to Resolution No. 18-NQ/TW, Resolution No. 60-NQ/TW, the National University will be transferred to the Ministry of Education and Training for management from September 1, 2025.
Therefore, the amendment of the Law on Emulation and Commendation was issued in 2022 to unify the authority and responsibility of the heads of agencies, organizations and units who directly lead, direct and are responsible for the results of emulation and commendation work;
Identify individuals, groups, and households with achievements to reward according to authority or propose superiors to reward; replicate advanced models.
The assessment of achievements; responsibility for the decision on commendation and the submission of commendation to higher levels as stipulated in Clause 1, Article 13 of the Law on Emulation and Commendation in 2022 also need to be studied not stipulating the authority of the Director of the National University to be directly commended by the Prime Minister to ensure consistency in the authority to propose commendation in the political system.
The draft Law accordingly amends and supplements regulations on the authority to recognize emulation titles and forms of commendation to suit the 2-level local government model after the reorganization.
In particular, the Ministry of Home Affairs has proposed to remove the authority to submit commendations to the Director of the National University to comply with the organization of the apparatus after the arrangement according to Resolution 18-NQ/TW and agree on the authority to propose commendations in the political system.
