The Ministry of Home Affairs is seeking opinions on the draft Law amending and supplementing a number of articles of the Law on Emulation and Commendation No. 06/2022/QH15.
According to the draft Proposal, implementing the Central Resolutions, Conclusions of the Politburo and the Secretariat on the implementation of the 2-level local government model, the removal of district-level regulations leading to the regulations on the authority to reward the Chairman of the District People's Committee stipulated in the Law on Emulation and Commendation in 2022 not being implemented in practice.
While the 2022 Emulation and Commendation Law stipulates that meritorious rewards are those of taking a lower emulation title to propose a higher emulation title.
For example: The title of "Advanced Worker" is the standard to award the title of "Emulation Fighter at the grassroots level"; the title of "Emulation Fighter at the grassroots level" is the standard to award the title of Emulation Fighter at the Ministry, Department, Branch, Province and the title of Emulation Fighter at the Ministry, Branch, Branch, Province is the standard to award the title of "National Emulation Fighter".
In addition, the title of "Emulation Fighter at the grassroots level", the title of Emulation Fighter of ministries, departments, branches and provinces are the criteria for considering and proposing awards for Certificates of Merit of Ministries, departments, branches and provinces, Certificates of Merit of the Prime Minister, and Labor Medals of all ranks.
Therefore, it is necessary to promptly amend the regulations on the authority to reward the Chairman of the District People's Committee to ensure the rights of individuals and groups with achievements in building and defending the Fatherland; in line with the current model of organizing local government at 2 levels.
In order to not create legal gaps in implementing legal regulations on emulation and rewards, Article 59 of Decree No. 129/2025/ND-CP dated June 11, 2025 of the Government has transferred the authority to reward the Chairman of the District People's Committee in Clause 2, Article 80 of the Law on Emulation and Rewards to the Chairman of the Commune People's Committee for implementation.
However, the Ministry of Home Affairs believes that it is necessary to amend and supplement the Law on Emulation and Commendation to improve the legal basis, synchronize and unify legal regulations on emulation and commendation.
The draft Law has amended and supplemented regulations on the authority to recognize emulation titles and forms of commendation to suit the 2-level local government model after the reorganization.
Accordingly, amending and supplementing the authority of the Chairman of the Provincial People's Committee to decide to award "otang of typical commune, ward, and town" to the decision to award "otang of typical commune, ward, and special zone" to suit the model of organizing local government at 2 levels (no more towns under the province).
Transfer the authority to decide to award the titles of villages and cultural residential groups, "Advanced labor collective", "Emulation fighter at the grassroots level", "Advanced worker" and certificates of merit from the Chairman of the District People's Committee to the Chairman of the Commune People's Committee to comply with the model of organizing local government at 2 levels (due to no longer being at the district level).
The Ministry also proposed to remove the authority to submit commendations for "National University Directors" to comply with the post-arrangement apparatus organization according to Resolution 18-NQ/TW and agree on the authority to propose commendations in the political system (currently National University under the management of the Ministry of Education and Training).
