The Ministry of Home Affairs requests localities to sign contracts to support commune-level civil servants, and people working under contracts are not included in the payroll.

To ensure human resources for the commune level, the Ministry of Home Affairs said that it has sent documents to localities requesting to focus on implementing plans to ensure personnel at the commune level to meet the requirements of operating local governments at 2 levels.

To continue to perform this task, promptly resolve difficulties and obstacles from practical implementation and deploy the direction of competent authorities, the Ministry of Home Affairs continues to request localities to urgently review and comprehensively assess the quality of the contingent of cadres and civil servants at the commune level; the ability to meet the requirements of the assigned job position (ensuring the principle of right person, right job, right area).

Thereby, specifically identifying the need to supplement human resources according to each job position to implement recruitment and reception to become civil servants within the assigned payroll.

The Ministry of Home Affairs also proposed to minimize the implementation time of the recruitment and reception process according to Decree No. 170/2025/ND-CP regulating the recruitment, use and management of civil servants.

In case communes, wards, and special zones still have staff and have recruitment needs, but do not have sufficient conditions to organize a separate recruitment period, they shall summarize and report to the Provincial People's Committee to organize recruitment according to their authority, and allocate the number of employees to communes and wards as required.

The Ministry of Home Affairs requests localities to proactively develop plans to implement labor contracts or service contracts for professional, nghiệp vụ or support services, which existing human resources cannot meet, in order to serve internally for agency, organization, and unit activities.

Accordingly, localities are allowed to sign labor contracts to support civil servants in performing assigned tasks at professional and nghiệp vụ job positions at the commune level specified in Decree No. 361/2025/ND-CP and regulations of the Central Organization Committee on the list of job positions in the Party bloc, Fatherland Front, socio-political organizations.

The person signing the contract performing the tasks of a civil servant is not included in the assigned payroll of agencies, organizations, and units.

The costs of contract signing are guaranteed by the state budget, outside the salary fund and outside the contracted administrative expenses of organizations, agencies, and units. The allocation of funds, preparation of estimates, management, use, and finalization of funds shall be implemented in accordance with the provisions of Circular No. 144/2025/TT-BTC.

Localities are mobilized resources according to the provisions of law to implement the signing of contracts according to the provisions of Decree No. 173/2025/ND-CP on contracts for performing the tasks of civil servants.

According to the proposal of the Ministry of Home Affairs, localities need to proactively apply solutions suitable to the actual conditions to supplement human resources for the commune level, such as mobilizing, arranging, assigning work for sources from other places, transferring staff... according to their authority.

According to Dr. Nguyen Tien Dinh - former Deputy Minister of Home Affairs, after the merger, many fields such as land, environment, and land administration often fall into overload. To remove difficulties, the Central Government allows localities to transfer civil servants between communes and wards or sign labor contracts with professionals, including from non-state sectors. This is considered a new approach, helping to overcome the shortage of human resources and ensure smooth operation of the two-level government apparatus.

On the other hand, the examination, selection, or reception of civil servants according to Decree 170/2025 among the unused staff is also considered a step forward, expanding opportunities to attract talents to work at the grassroots level. This contributes to improving the quality of the commune-level civil servant team, meeting the increasing requirements of tasks.
