Based on practical needs, the book "Handbook of organization and operation of local government at the commune level" was compiled by the Ministry of Home Affairs (in paper and electronic versions) to provide systematic, complete and easily accessible information for commune-level cadres and civil servants in implementing the Law on Organization of Local Government 2025 and new relevant legal documents.
The content of the "Local Government at the Commune Level" Handbook is designed in a practical and clear direction, concretizing responsibilities, tasks, powers, working relationships and handling situations arising at the grassroots level, ensuring unity and effectiveness in organization and implementation.
The Handbook is divided into 6 main parts, each focusing on important aspects of the organization and operation of commune-level government.
Notably, the Ministry of Home Affairs has devoted 1 chapter to clearly stating the regulations on the transfer and removal of the positions of Chairman of the People's Committee, Vice Chairman of the People's Committee at the commune level and assigning the authority of the Chairman of the People's Committee at the commune level.
According to the provisions of Article 41 of the Law on Organization of Local Government 2025, the Chairman of the Provincial People's Committee decides to transfer the Chairman of the People's Committee and Vice Chairman of the Commune People's Committee; decides to remove the Chairman of the People's Committee and Vice Chairman of the Commune People's Committee when the Chairman of the People's Committee and Vice Chairman of the People's Committee commits violations of the law or do not properly perform their assigned duties and tasks.
For the above cases, the People's Councils at the commune level did not carry out the procedures for dismissal, removal and reporting to the People's Councils at the commune level at the most recent meeting.
The Chairman of the People's Committee and Vice Chairman of the People's Committee who are transferred or dismissed from their duties shall cease to perform their duties from the date the transfer or dismissal decision takes effect.
According to the provisions of Article 42 of the Law on Organization of Local Government 2025, during the period of Chairman's absence, the Standing Committee of the People's Council at the commune level shall submit to the Chairman of the Provincial People's Committee for decision to assign the authority of the Chairman of the People's Committee at the same level. The acting Chairman of the People's Committee shall terminate the performance of duties from the date the People's Council elects the Chairman of the People's Committee.
