The draft Law on Organization of Criminal Investigation Agencies (amended) drafted by the Ministry of Public Security is expected to be submitted to the National Assembly for consideration and comments at the 9th Session of the 15th National Assembly in 2025.
In particular, the draft Law has amended and supplemented regulations on the duties and powers of the provincial-level police investigation security agency.
Accordingly, the security investigation agency of the provincial police organizes criminal duty, receives denunciations and reports of crimes and recommendations for prosecution; classifies and directly resolves denunciations and reports of crimes and recommendations for prosecution under its authority or immediately sends them to the competent authority for settlement.
Conduct an investigation of criminal cases on crimes specified in Chapter XIII, Chapter XXVI and crimes specified in Articles 207, 208, 282, 283, 284, 299, 300, 303, 304, 305, 309, 337, 338, 347, 348, 349 and 350 of the Penal Code when those crimes are under the Jury's authority.
Conduct an investigation of criminal cases related to national security or to ensure objectivity as assigned by the Minister of Public Security.
Direct, inspect, and guide agencies of the People's Security Forces under the Provincial Police assigned to conduct a number of investigation activities to conduct investigation activities.
Recommend relevant agencies and organizations to apply measures to remedy the causes and conditions for crime.
Organize a preliminary review and summary of the work of receiving and handling denunciations and reports on crimes, recommendations for prosecution and the work of investigating and handling crimes of the People's Security Forces under the Provincial Police to report to the Head of the Ministry of Public Security's Investigation Security Agency.
Resolve complaints and denunciations according to the provisions of the Criminal Procedure Code.
