The Ministry of Justice is reviewing the draft Decree amending and supplementing a number of articles of Decree No. 150/2025/ND-CP. The draft Decree was drafted by the Ministry of Home Affairs.
Accordingly, the Ministry of Home Affairs proposed to amend and supplement Clause 1, Article 11 of Decree 150/2025/ND-CP stipulating the position and functions of specialized departments under the People's Committees at the commune level as follows:
"The department is a specialized agency under the People's Committee at the commune level. The Department has legal status, its own seal and account according to the provisions of law; performs the function of advising and assisting the People's Committees at the commune level in state management of local sectors and fields according to the provisions of law".
Currently, Clause 1, Article 11 of Decree 150/2025/ND-CP stipulates as follows: The Department is a specialized agency under the People's Committee at the commune level; performs the function of advising and assisting the People's Committees at the commune level in state management of local sectors and fields according to the provisions of law.
Meanwhile, Article 12 of the Decree clearly states the tasks and powers of the department, in which the department has the right to submit to the People's Commune-level People's Committee draft resolutions and decisions related to the department's field; draft plans and programs; perfect the organization of the department apparatus; perform professional management.
Specialized departments are organized at the commune level to advise and help the People's Committees of communes perform the function of state management in specific areas as stipulated in Article 13 of the Decree.
According to the Ministry of Home Affairs, the proposed amendments in the Draft Decree are the result of summarizing the implementation of Resolution No. 18-NQ/TW, aiming to continue to arrange and streamline the organization of the state administrative apparatus, ensuring a strong spirit of decentralization and delegation of power along with strengthening inspection and supervision, while creating a flexible mechanism for localities to decide on their own organizational structure in accordance with their actual conditions. These regulations are expected to help improve the effectiveness and efficiency of state management at the grassroots level.
