Proposing new standards for commune-level department heads and deputy heads

The Ministry of Home Affairs proposes specific standards for each title of civil servant in leadership and management at the department level and equivalent in the commune.

The Ministry of Justice is reviewing the Draft Decree regulating the standards for civil servant titles of leaders and managers in state administrative agencies drafted by the Ministry of Home Affairs.

According to the draft Decree, the group of titles of department heads and equivalent to communes includes the chief of staff of the People's Council (PC) and People's Committee (PC) of communes; department heads and directors of centers under the People's Committees of communes, wards, special zones and equivalent titles.

The group of deputy heads of departments and equivalents under the commune includes deputy heads of the People's Council and People's Committee offices; deputy heads of departments and deputy directors of centers under the People's Committees of communes, wards, special zones and equivalents.

The draft states that the standards for commune-level civil servants and leaders are inherited from the regulations on provincial-level standards in Decree No. 29/2024/ND-CP and adds additional requirements in accordance with the functions and tasks of the commune level.

Standards for department heads and equivalent in communes

Commune-level civil servants must meet general standards of political qualities, ethics, and lifestyle; have prestige among cadres, civil servants, and people; have appropriate professional qualifications; and meet the requirements of political theory, state management, legal knowledge, and the ability to perform tasks. Leaders must also ensure their health and have work experience according to regulations.

The draft clearly states specific standards for department heads and equivalents in communes. The person holding this position must have a firm grasp of his expertise and profession; be able to organize the implementation of policies and laws related to the assigned industry, field or task; and at the same time advise, inspect and handle according to the provisions of the law in the area. In addition, civil servants must be able to propose or directly resolve recommendations, complaints and denunciations under their authority.

Regarding experience requirements, the draft stipulates two cases:

People holding the position of deputy head of the department and equivalent in the commune can be considered for appointment if they meet general standards.

In case of not holding the position of deputy, civil servants must have worked continuously in the industry or field for at least 4 years to be considered for appointment as department heads and equivalents under the commune.

Standards for deputy department heads and equivalent in communes

The draft stipulates standards for deputy department heads and equivalents in communes. The person holding this position must have a firm grasp of his expertise and expertise; implement the State's policies, laws and guidelines; advise, inspect and handle according to regulations in the area; and synthesize and propose solutions to recommendations, complaints and denunciations under his/her authority.

Civil servants considered for appointment as deputy department heads and equivalent must have worked continuously in the industry or field for 2 years or more.
