The Ministry of Home Affairs is seeking public opinions on the draft Decree on work contracts in public non-business units (DVSNCL). It is expected that this Decree will take effect from July 1, 2026.
In the Draft Submission, the Ministry of Home Affairs said that through the implementation process, Decree No. 111/2022/ND-CP has revealed some limitations, not keeping up with the requirements of innovation in public sector governance and not fully compatible with the orientations of the Law on Civil Servants in 2025.
The issuance of a decree on work contracts in CBs is necessary to ensure the unity and synchronization of the legal system; remove obstacles in the practice of signing and implementing contracts; improve the salary mechanism according to agreements to attract and retain talent; create a transparent and flexible legal framework but still ensure control of power and accountability.
Regarding the number of signed contracts, the Ministry of Home Affairs has made specific proposals.
Accordingly, VNU-CLs self-ensure regular and investment expenditures (hereinafter referred to as group 1 units) and VNU-CLs self-ensure regular expenditures (hereinafter referred to as group 2 units) decide to sign contracts according to the unit's human resource needs.
In case the law stipulates the minimum number of public employees of basic and essential public service providers, it is necessary to ensure sufficient quantity according to regulations.
Private enterprises self-ensure a part of regular expenditures (hereinafter referred to as group 3 units) from 70% to less than 100% of signing contracts in professional and nghiệp vụ positions and supporting job positions for the number that is still lacking compared to the number of employees set by the ministry managing the industry and field.
For self-guaranteed units under 70% of recurrent expenditures or units that have not been granted financial autonomy, they must report to competent management agencies for unified approval before implementation.
Public non-business units guaranteed by the State for regular expenditures (hereinafter referred to as group 4 units), except for units in the field of education and healthcare, signing contracts for the number that is still lacking compared to the number of employees assigned by competent authorities or to promptly replace the number of public employees on maternity leave, resignation, or retirement.
Group 4 units in the field of education and health services sign labor contracts for jobs in professional and nghiệp vụ positions, but the number of people signing labor contracts does not exceed 70% of the difference between the number of people present and the number according to the norms issued by the Ministry of Education and Training and the Ministry of Health.
The number of signed contracts is considered and decided by the Provincial People's Council or ministries, ministerial-level agencies, government-attached agencies, and central management agencies.
