The Ministry of Justice is reviewing the Draft Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes, wards and special zones under provincial levels.
This draft decree, developed by the Ministry of Home Affairs, will replace Decree 45/2025 of the Government.
The Ministry of Home Affairs said that in order for provincial-level specialized agencies to effectively perform their assigned functions, tasks and powers within the conditions of expanded scale and scope of management, it is necessary to amend the regulations on the number of deputy heads of departments and specialized departments under the department and the minimum staffing criteria when establishing departments accordingly.
Accordingly, for specialized agencies under the Provincial People's Committee, the draft decree proposes regulations on the criteria for determining the number of deputy heads of specialized departments and the minimum staffing criteria when establishing specialized departments under the department as prescribed for departments under the department in Hanoi and Ho Chi Minh City.
Provinces and cities are organized with no more than 14 departments, Hanoi and Ho Chi Minh City alone have no more than 15 departments.
In which, the departments are organized uniformly in the locality including: Department of Home Affairs, Justice, Finance, Industry and Trade, Agriculture and Environment, Construction, Science and Technology, Culture - Sports and Tourism, Education and Training, Health, Provincial Inspectorate, People's Committee Office.
Specific departments are organized in a number of localities including the Departments of Foreign Affairs, Ethnic Minorities and Religions, Tourism, and the Departments of Planning and Architecture established in Hanoi and Ho Chi Minh City.
The provisions on this content in the draft remain the same as the current one.
The organizational structure of the department includes: Professional and technical departments; offices (if any); equivalent departments and organizations (if any); public service units (if any).
The number of deputy heads of professional and technical departments under the department is regulated as follows: Departments under the department with less than 10 civil servant positions are assigned 1 deputy head of the department; Departments under the department with from 10 to 14 civil servant positions are assigned no more than 2 deputy heads of departments.
In addition, departments under the department with 15 or more civil servant positions are arranged with no more than 3 deputy heads of departments (maintained as prescribed in Decree No. 45/2025).
Regarding the minimum staffing criteria when establishing a professional and technical department under the department, the workload required to arrange a minimum of 7 civil servant positions.
The draft decree also proposes to stipulate that each department will have an average of 4 deputy directors, an increase of 1 deputy director compared to current regulations.
In Hanoi and Ho Chi Minh City alone, in addition to the total number of deputy directors of departments according to the general average, Hanoi will be increased by no more than 10 deputy directors and Ho Chi Minh City will be increased by no more than 15 deputy directors.
According to current regulations, departments under the departments of Hanoi and Ho Chi Minh City have less than 10 civil servant positions, departments under provincial level I have less than 9 civil servant positions and departments under provincial level II and type III have less than 8 civil servant positions, and 1 deputy head of the department is assigned.
Departments under the departments of Hanoi and Ho Chi Minh City have from 10 to 14 civil servant positions, departments under provincial level I have from 9 to 14 civil servant positions and departments under provincial level II and type III have from 8 to 14 civil servant positions arranged with no more than 2 deputy department heads; Departments under the department with 15 or more civil servant positions are arranged with no more than 3 deputy department heads.
