The Government has just issued Decree 67/2025/ND-CP amending and supplementing a number of articles of Decree 178/2024/ND-CP on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the reorganization of the apparatus of the political system.
In the decree, the Government removed Clause 6, Article 19 stipulating that the People's Committees of provinces and centrally run cities shall, based on their ability to balance local budgets, submit to the People's Councils at the same level to issue additional support policies for subjects under their management.
The Government also stipulates: "Cases that have been granted additional support policies from local budgets by competent authorities as prescribed in Clause 6, Article 19 of Decree No. 178 before March 15, 2025 will still enjoy this additional support policy".
Regarding this content, according to the draft decree submission, the Ministry of Home Affairs said that some localities have issued Resolutions of the Provincial People's Councils on additional support policies for subjects settled according to the provisions of Decree No. 178 with too large support differences.
The Ministry of Home Affairs cited the reality that some provinces support at 100%, some provinces support at 10%, some provinces support at the absolute maximum amount of 300 million VND/person.
"Therefore, to ensure the correlation of policies and regimes between the central and local governments and between localities, it is recommended to stipulate that the local additional support policy is a maximum of 30%," the Ministry of Home Affairs proposed.
Thus, the Government has abandoned the proposal of the Ministry of Home Affairs. Accordingly, cadres, civil servants and public employees who quit their jobs when streamlining the apparatus in addition to the policies and regimes enjoyed under Decree 178 will not receive additional support policies from the locality.
Adding "salary retention difference coefficient"
Regarding the determination of current monthly salary to calculate policies and regimes, Decree 67/2025 adds a "salary retention difference coefficient" to ensure the rights of cadres, civil servants, public employees and workers when they retire.
The current monthly salary is the salary of the month immediately preceding the leave, including:
Salary level according to rank, grade, rank, position, title, professional title or salary level according to agreement stated in labor contract; salary allowances and salary retention coefficient difference (if any) according to the provisions of law on salary.
In which, salary allowances include: leadership position allowance; seniority allowance beyond the framework; seniority allowance; preferential allowance according to profession; responsibility allowance according to profession; public service allowance; allowance for party work, socio-political organizations; special allowance for armed forces.
Compensation for officials
Decree 67/2025 clearly states that in cases where policies and regimes are being resolved due to the reorganization of the apparatus and administrative units at district and commune levels according to the provisions of Decree No. 29/2023 of the Government (on staff streamlining) but the competent authority has not yet issued a decision to resolve policies and regimes, the policies and regimes prescribed in the decree will be applied.
In cases where policies and regimes are being resolved due to the arrangement of district and commune-level administrative units, and have been resolved by competent authorities according to Decree No. 29/2023, but the time of resignation after January 1, 2025 will be subject to the policies and regimes prescribed in this decree.
In cases where competent authorities have resolved policies and regimes according to Decree No. 177, if the policies and regimes are lower than the policies and regimes prescribed in this decree, the policies and regimes prescribed in this decree will be applied.
Cases that have been resolved by competent authorities according to the policies and regimes prescribed in Decree No. 178, if the policies and regimes are lower than the policies and regimes prescribed in this Decree, will be supplemented according to the policies and regimes prescribed in this Decree.
