Ms. Pham Thi Thanh (name changed) learned that Article 73 of the Law on Emulation and Commendation stipulates regulations on Certificates of Merit from the Prime Minister.
Accordingly, the Prime Minister's Certificate of Merit is awarded or posthumously awarded to individuals who have well implemented the Party's guidelines, policies and laws of the State and achieved one of the prescribed criteria.
According to point b, clause 1, Article 73: Having been awarded a certificate of merit by the Ministry, department, branch, province and continuously for 5 years or more up to the time of requesting recognition for completing tasks well or better, during which time the title "Basic Emulation Fighter" has been awarded 3 times.
"Can provincial-level civil servants who receive a Certificate of Merit from a Ministry or Sector be recommended for a Certificate of Merit from the Prime Minister? Does this subject need a Certificate of Merit from the Provincial People's Committee to be considered a Certificate of Merit (other conditions are ensured according to the Law on Emulation and Commendation)?" - Ms. Thanh wondered.
Regarding the reflection and recommendation of Ms. Pham Thi Thanh, the Ministry of Home Affairs has responded on the Electronic Information Portal.
At Point b, Clause 1, Article 73 of the Law on Emulation and Commendation stipulates one of the criteria for awarding or posthumously awarding a Certificate of Merit from the Prime Minister to an individual as follows: Having been awarded a Certificate of Merit from a Ministry, Department, Branch, or Province and continuously for 5 years or more up to the time of requesting recognition for completing tasks well or better, during which time the title of "Emulation Fighter at the grassroots level" has been awarded 3 times.
Clause 3, Article 4 of Decree No. 98/2023/ND-CP dated December 31, 2023 of the Government detailing the implementation of a number of articles of the Law on Emulation and Commendation stipulates: The results of commending outstanding achievements and emulation by topic are not used as a basis for proposing superiors to commend meritorious achievements.
According to the Ministry of Home Affairs, in comparison with the above regulations, civil servants under the management of the provincial level are awarded Certificates of Merit by the Ministry or branch, which is a specialized form of reward; therefore, they cannot be used as a criterion to propose the award of Certificates of Merit by the Prime Minister according to the provisions of Point b, Clause 1, Article 73 of the Law on Emulation and Commendation.
