Ministry of Home Affairs guides the implementation of policies on streamlining the apparatus

The Ministry of Home Affairs has issued Circular 01/2025 guiding the implementation of Decree No. 178/2024, which officially takes effect from January 1, 2025.

Minister of Home Affairs Pham Thi Thanh Tra signed and issued Circular No. 01/2025 guiding the implementation of policies and regimes for cadres, civil servants, public employees and workers in the implementation of organizational restructuring of the political system (guidance on the implementation of Decree No. 178/2024 of the Government).

The subjects of application of Circular No. 01/2025 include cadres, civil servants, and public employees; commune-level cadres, civil servants, and employees specified in Points a, b, and c, Clause 1, Article 2 of Decree No. 178/2024.

Notably, Article 8 of the Circular clearly states the organization of implementation.

Accordingly, implementing the provisions of Clause 2, Article 24 of Decree No. 178/2024/ND-CP, those who have enjoyed the policies prescribed in Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government on streamlining payroll before January 1, 2025 will not enjoy the policies and regimes prescribed in this Circular.

Previously, the Government issued Decree No. 178/2024 dated December 31, 2024, stipulating the regime and policies for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system, effective from January 1, 2025.

Director, Chief of Office of the Party Committee of the Ministry of Home Affairs Nguyen Quang Dung said that this Decree sets out 8 main policy groups:

Policy applicable to people retiring before the age; policy on severance pay for officials and civil servants; policy on severance pay for public employees and workers;

Policy for cadres, civil servants, and leaders and managers who cease to hold positions or are elected or appointed to lower leadership and management positions; policy for people on business trips to the grassroots;

Policy on promoting people with outstanding qualities and abilities; policy on training and improving the qualifications of cadres and civil servants after reorganization; policies and regimes for those in the armed forces.

Clause 2, Article 24 of the Decree clearly states: "Those who have enjoyed the policies prescribed in Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government on streamlining payroll before January 1, 2025 shall not enjoy the policies and regimes prescribed in this Decree".

Thus, according to the above regulations, if cadres, civil servants and public employees have enjoyed the policy on streamlining the payroll before January 1, 2025, they will not enjoy the policies and regimes in implementing the organizational arrangement of the political system.

Regarding transitional provisions, Article 15 of the Decree stipulates: Cases in which policies and regimes are being resolved due to the reorganization of the apparatus and administrative units at district and commune levels as prescribed in Decree No. 29/2023/ND-CP but the competent authority has not yet issued a decision to enjoy the policies and regimes shall apply the policies and regimes prescribed in this Decree.

According to Mr. Nguyen Quang Dung, Decree No. 178/2024 inherits Decree 29/2023 regulating staff streamlining, but the subsidy levels have increased.
