Mr. Nguyen Van Loi (character's name has been changed) said that according to Official Dispatch No. 1350/SNV-CCVC dated June 28, 2025 of the Department of Home Affairs of Bac Kan province (old) on the arrangement, arrangement and use of contract workers, he was transferred to work at the People's Committee of Cuong Loi commune.
After that, the Chairman of the People's Committee of Cuong Loi Commune issued Decision No. 02/QD-UBND dated July 3, 2025 on authorizing the signing of a Labor Contract at the Office of the People's Council and People's Committee of Cuong Loi Commune.
From there, Mr. Loi asked: "Is the subject signing the labor contract with you the People's Council - People's Committee Office of the commune? ".
In addition, Mr. Nguyen Van Loi also proposed to clarify which documents are the basis for signing the previous indefinite-term contract to be converted to a 6-month contract.
Regarding Mr. Loi's question, the Ministry of Home Affairs responded on the Electronic Information Portal.
Clause 1, Article 7 of Decree No. 111/2022/ND-CP stipulates the authority to sign contracts for support and service work for administrative agencies by the head of the administrative agency.
Meanwhile, this administrative agency is identified as the focal point assigned to the payroll and administrative management funds from the state budget, which is the person with the authority to sign the contract and decide on the number of contracts or can be decentralized and authorized in writing to the head of the agency or unit under or directly under the implementation.
Regarding the determination of the labor contract signing period, the Ministry of Home Affairs recommends that he follow the provisions of the Labor Code.
