The Ministry of Home Affairs is seeking opinions on the Draft Decree on determining the authority of the internal affairs sector when organizing local government at 2 levels.
The Ministry of Home Affairs said that according to current law, local government includes 3 levels: Provincial level, district level and commune level.
The current legal system, including laws on internal affairs, has many regulations related to the tasks and authority of state agencies at the district level.
Implementing Conclusion No. 127-KL/TW, expected to amend the 2013 Constitution, expected to amend the Law on Organization of Local Government with the policy of not organizing district-level government, district-level state agencies will be dissolved (District People's Committee, District People's Council...) or merged according to the regional model (prosecutor, court, tax, execution of judgments...).
Thus, the tasks and authority of district-level state agencies need to be adjusted according to current law to meet the requirements of state management.
The Ministry of Home Affairs said that it is expected to transfer 120 contents in 8 fields from the district level to the commune level, including: Documentation and state archives; emulation and rewards; salary - social insurance; employment, labor safety; cadre organization; youth and gender equality; non-governmental organizations; meritorious people.
At the same time, the provincial level plans to receive from the district level 21 contents in 4 areas including: Official documents and state archives; emulation and rewards; salary - social insurance; employment, labor safety.
Regarding the principle of determining the authority, according to the Ministry of Home Affairs and the commune level, mainly implementing policies from the central and provincial levels issued, focusing on serving the people, directly solving problems of the community, providing basic and essential public services for people in the area.
The new commune-level government assumes the tasks and powers of the local government at the commune level and the tasks and powers of the current district-level local government.
Provincial local authorities shall manage, inspect and supervise the activities of commune-level local authorities.
