Continuing the 9th Session, on the morning of May 10, National Assembly deputies discussed in the hall a number of contents with different opinions of the draft Law amending and supplementing a number of articles of the Law on Advertising.
The draft law clearly stipulates the responsibility of organizations and individuals participating in online advertising and cross-border advertising activities to prevent and remove violating advertising. In case of failure to do so, the competent authority will deploy technical measures to prevent and handle the measure according to the provisions of law.
Contributing opinions to the draft law, delegate Trinh Xuan An - National Assembly Delegation of Dong Nai province - said that with the incidents that have occurred in recent times, the most difficult thing in advertising is the person who influences and affects advertising. People affected by Decree 55 are not only people with qualifications and professional capacity but also people who are noticed by society, have a significant number of people interested in and following them in the media or have accounts that are eligible to participate in advertising and business programs on digital platforms.

According to Mr. An, there are 4 groups of people who are noticed by society: Miss, model, singer, actor, scandal creator on social networks who attract attention.
"Miss, the actors don't understand anything about the product but still advertise because of the beautiful image of the person. When a product is advertised, consumers only pay attention to the advertiser. As for business people with product services, they are almost not cared about" - National Assembly delegate Trinh Xuan An raised the issue.
From this reality, Mr. An suggested tightening advertising activities for influential people.
"Only those who are involved or have a level of capacity related to the product are advertised. That way we can tighten advertising" - Mr. An emphasized.
According to the viewpoint of delegate Nguyen Tam Hung - National Assembly Delegation of Ba Ria - Vung Tau province, some provisions in the draft are unclear, or do not ensure feasibility.
The delegate gave an example, Clause 3, Article 15, people affected by the transfer of advertising products are obliged to verify the reliability of advertisers; check documents related to products, goods, advertising services; in case of not using or not clearly understanding goods, products, services, they are not allowed to introduce goods, products, services...

"This is a convincing regulation but lacks specific instructions, easily causing difficulties in implementing and handling violations. Therefore, I propose to add a clearer definition of influential people in the digital environment according to interaction criteria, the level of audience participation and a process to guide the transparency of sponsorship content according to international practices. Clearly stipulate the joint responsibility between influential people on digital platforms and advertisers in case of false advertising" - Mr. Hung suggested.
