The Ministry of Home Affairs has just issued a Draft report summarizing the Law on Civil Servants 2010 (amended and supplemented in 2019).
According to the draft, as of December 31, 2023, the whole country has 1,743,326 civil servants.
Regarding the implementation of the termination and retirement regime, the Ministry of Home Affairs stated that the termination and retirement regime for civil servants is specifically regulated in the Government's regulations on recruitment, use and management of civil servants.
The settlement of the termination and retirement regime for civil servants is implemented by ministries, agencies and localities in accordance with their authority, order and procedures; ensuring the rights of civil servants according to the provisions of the Law on Civil Servants and the law on labor.
Since the end of 2019, there has been a situation where a number of civil servants have resigned at personal request, mainly concentrated in educational and medical service units, causing difficulties in human resources for the operations of many localities and units.
The Ministry of Home Affairs said that from January 2020 to June 2022 alone, 35,523 civil servants have resigned, mainly in education and health service units.
In addition to the reason that the autonomy mechanism, socialization of public career activities and services create healthy competition according to the labor supply and demand relationship between the public and private sectors in the context of a market economy, there is also the reason that salaries and incomes of civil servants are still low compared to the income of workers and the working qualifications in state-owned enterprises, private sectors, and areas with foreign investment;
On the other hand, agencies and units have implemented staff streamlining at the request of the Party and State while the workload is increasing, leading to overload and pressure, especially in the health sector during the peak period of COVID-19 prevention and control.
In addition, the environment and working conditions at certain times in the public sector have not really created motivation and opportunities for civil servants to promote their abilities well.
In that context, the Government, ministries, agencies and localities have focused resources, implemented many practical measures to protect the legitimate rights and interests of civil servants, and effectively overcome the above situation.
