Preparing to submit the amended Law on Civil Servants and 4 Decrees guiding the Law on Cadres and Civil Servants

The Ministry of Home Affairs is focusing on developing and completing the draft revised Law on Civil Servants and 4 related draft Decrees to guide the Law on Cadres and Civil Servants.

The Ministry of Home Affairs said that 4 draft decrees include: Draft Decree regulating the national database on cadres, civil servants, and public employees in state agencies; decree on assessment and classification of civil servant quality; decree on standards for civil servant positions in leadership and management in state administrative agencies; decree on management of people holding positions, positions, and representatives of state capital in enterprises.

Previously, the Ministry of Home Affairs focused on researching, reviewing and proposing that the Government continue to strongly innovate the civil service and public employee regime to improve the quality of the team to meet the requirements of modern, effective and efficient national governance with specific solutions.

In particular, it has advised the National Assembly to pass the amended Law on Cadres and Civil Servants. This is a fundamental and comprehensive amendment to the management of cadres and civil servants, including: Connecting cadres and civil servants at the commune level with the provincial level, unifying a civil service regime from the central to the commune level without distinguishing between cadres and civil servants at the commune level and the provincial level; the mechanism for management and use of cadres and civil servants in a transparent and effective manner, in line with the requirements of administrative reform.

The Law also amends the transitional provisions for some contents for cadres and civil servants to comply with the requirements for resolving practical problems....

At the same time, the Ministry also advised the Government to issue new or amend and supplement legal documents related to the recruitment, use and management of cadres, civil servants and public employees to meet the requirements of the national administration.

The Ministry of Home Affairs continues to review and improve institutions, focusing on completing the draft Law on Civil Servants amended to submit to the National Assembly at the 10th session of the 15th National Assembly.

At the same time, the Ministry will develop decrees detailing the laws and resolutions that have come into effect, especially speeding up the development of decrees and circulars to ensure the effectiveness of the amended Law on Organization of Local Government and the amended Law on Cadres and Civil Servants.

In addition, the Ministry also effectively and synchronously implemented the model of local government at two levels and the policy of strengthening decentralization, delegation of authority, and division of authority according to the direction of the Government and the Prime Minister, ensuring smooth operation, without creating legal gaps.
