The Government has just issued Decree No. 347/2026/ND-CP dated September 8, 2026, amending and supplementing a number of articles of 4 related Decrees.
In which, Decree No. 347/2026/ND-CP amends and supplements points a, b, clause 2, Article 13 of Decree No. 105/2025/ND-CP on the content and authority to inspect fire prevention and fighting (PCCC) as follows:
The Police agency, according to decentralization, organizes periodic inspections once a year for establishments belonging to the prescribed group, construction works during construction subject to design appraisal, fire prevention and fighting design appraisal, and vehicles.
Conducting surprise inspections when there are signs of legal violations, complaints or denunciations about legal violations related to fire prevention and fighting according to regulations or at the request of competent authorities to serve security and order assurance for the prescribed establishment.
Contents of periodic and unscheduled inspections: for establishments according to regulations; for construction works during construction that are subject to design appraisal, fire prevention and fighting design appraisal according to regulations.
Provincial People's Committees assign and decentralize specialized agencies on construction to organize periodic inspections for establishments belonging to the prescribed group.
Conducting surprise inspections when there are signs of legal violations, complaints or denunciations about legal violations related to fire prevention and fighting and rescue according to regulations or when requesting coordination to serve the security and order assurance of competent authorities.
Also according to the decree, before December 15th every year, the Police agency, specialized construction agencies, and commune-level People's Committees according to decentralization shall develop periodic inspection plans for the following year for facilities, works, and means of transport under their management and be adjusted when necessary;
Establish an inspection team or assign officials to conduct inspections and send written notices on the time, content and composition of inspection participants to the subjects being inspected 3 working days in advance;
The head of the delegation or assigned official introduces the composition, content, methods and assigns members of the delegation to conduct fire prevention and fighting inspections according to their authority.
Decree No. 347/2026/ND-CP takes effect from September 15, 2026.
