Proposal to handle responsibilities related to the management and use of houses and land in Phu Tho

Existing in a series of housing and land facilities

The Government Inspectorate has issued Document No. 885/TB-TTCP Announcing the Inspection Conclusion on preventing and combating waste in the management and use of houses and land of state agencies, organizations, and enterprises in Phu Tho province.

Notably, through inspection and verification of the management and use of houses and land at some agencies and units, the Government Inspectorate has pointed out many shortcomings and limitations.

Typically, Vinh Phuc Provincial Youth and Children's Activity Center: Leasing, joint ventures, and associations for infrastructure without a project approved by a competent authority, from January 1, 2019 to September 4, 2020, failing to report on the annual management and use of public assets.

Phu Tho Provincial Conference Center, facility 2, Me Linh commune, Hanoi City: Vinh Phuc Provincial People's Committee allocated land to the Guest House of the Provincial People's Committee Office in Decision No. 2751/QD-UBND dated July 30, 2008 when there was no investment project approved by competent authorities, which is not in accordance with regulations. The responsibility belongs to Vinh Phuc Provincial People's Committee in 2008.

Vinh Phuc Obstetrics and Pediatrics Hospital (old facility), Vinh Phuc province: The unit using the house and land facility (Vinh Phuc Obstetrics and Pediatrics Hospital, Department of Health) proposed a plan to arrange and handle 03 houses and land facilities as "returning land use rights to the Provincial People's Committee"; Vinh Phuc Provincial Department of Finance advised the Chairman of the Provincial People's Committee to approve the arrangement and handling plan as "being used as a field hospital", not based on the proposal of the user unit and not belonging to the forms of handling houses and land facilities when rearranging according to regulations. Responsibility belongs to the Provincial People's Committee and Vinh Phuc Provincial Department of Finance.

Many other shortcomings are also raised for housing and land facilities: Xuan Ang General Clinic, Hien Luong commune, Phu Tho province; Phu Tho Provincial Library; Headquarters of Tam Dao Town People's Committee, Tam Dao district...

Proposal for handling responsibilities

The Inspector General of the Government proposed that the Prime Minister assign the Chairman of Phu Tho Provincial People's Committee to direct, organize, implement, and handle according to his authority, specifically:

Phu Tho Provincial People's Committee organizes reviews and directs the Department of Finance, agencies, organizations, units and local authorities (where there are houses and land) to organize reviews of the responsibilities of collectives and individuals involved in the implementation of management, use and reporting declarations, preparation, appraisal, and approval of plans for rearranging and handling houses and land mentioned in this Inspection Conclusion.

Based on the results of the review, the Chairman of the Provincial People's Committee handles responsibilities according to his authority or proposes competent authorities to handle responsibilities for collectives and individuals with violations according to regulations. In the process of organizing implementation, if signs of criminal law violations are detected, they shall be transferred to the investigating agency for handling according to the provisions of law.

The Government Inspectorate also requested the Chairman of Phu Tho Provincial People's Committee to direct the timely and effective organization of the arrangement, handling, management, and use of public houses and land assets, ensuring compliance with the provisions of law, for the right purpose, efficiency, and avoiding loss and waste.
