On March 11, according to the Ministry of National Defense's Electronic Information Portal, the Ministry of National Defense received a petition from voters of Ha Tinh province on amending the Law on Military Service 2015, in which it was concerned about regulations on registration for service when changing the place of residence or workplace, study place; temporarily postponing military service;
The regulation that citizens who are receiving full-time university and college training are temporarily deferred for one training course.
Responding to this content, the Ministry of National Defense said that the 2015 Law on Military Service was passed at the 9th Session of the 13th National Assembly. The Law takes effect from January 1, 2016, along with the issued documents detailing the implementation of the Law, creating a legal corridor, improving the effectiveness of state management of military service.
However, the implementation of the Law has revealed some problems and inadequacies in military service registration such as when changing the place of residence or work or study for some cases of citizens temporarily absent, leaving their place of residence, working or studying.
This leads to a lack of citizens ready to join the army but not being fully and promptly handled, leading to a situation of taking advantage to evade military service, making it difficult to grasp and manage local resources and causing bad public opinion among the people.
Previously, the Ministry of National Defense responded to voters in Vinh Phuc province's proposal to amend Article 41 of the 2015 Law on Military Service on temporary deferment of military service while studying.
However, cases of extended study, admission, debt, and retaking exams have not been specifically regulated, leading to the situation of taking advantage to evade military service, which is one of the difficulties in calling citizens to join the army by local authorities.
Responding to the petition of voters in Vinh Phuc province, the Ministry of National Defense said that the implementation of the Law has revealed a number of problems and inadequacies such as military service registration, citizen management of military service age for students who are admitted to college or university and are allowed to transfer to military service and temporarily postpone military service;
Some cases of extended extra classes, transfer fees, debt, retaking exams or not moving military service to the locality or to a new place of residence, but there are no regulations and sanctions to handle them fully, leading to the situation of taking advantage to avoid performing military service, causing difficulties in grasping and managing local resources and public outrage.
Implementing the direction of the Prime Minister in Official Dispatch No. 924/VPCP-NC dated February 12, 2022 on assigning the Ministry of National Defense to propose amending and supplementing the Laws and Decrees related to the Law on Military Service in 2015, the Ministry of National Defense has established a Steering Committee and a Research Team to propose drafting the Law on amending and supplementing a number of articles of the Law on Military Service in 2015.
