It is expected that documents issued by competent authorities to individuals and organizations before the merger of provinces and communes will still be used if they have not expired.

The Ministry of Home Affairs has just completed the submission and draft Resolution of the National Assembly Standing Committee on the arrangement of administrative units to send to the Ministry of Justice for appraisal.

Regarding the conversion of documents to individuals and organizations, the draft Resolution clearly states that documents that have been issued by competent authorities to individuals, citizens and organizations before the arrangement according to the old administrative unit, if they have not expired according to regulations, will continue to be used.

The draft Resolution also requires the People's Committees at the provincial level to direct the People's Committees at the commune level to proactively reorganize administrative units to develop a plan to propagate and implement the conversion of documents for individuals and organizations.

At the same time, localities need to create favorable conditions for individuals and organizations when carrying out procedures for converting documents and not collect fees and charges when converting due to changes in administrative unit boundaries.

In addition to the regulation on converting documents for individuals and organizations, the draft Resolution also clearly states the criteria and principles of arrangement for provincial and commune-level units in the direction of closely following the 6 criteria that have been reviewed and agreed upon by the Politburo.

These are criteria on natural area; population size; criteria on history, tradition, culture, religion, ethnicity; criteria on socio-economy (including criteria on geographical location, scale and level of economic development); criteria on geopolitics; criteria on national defense and security.

In particular, the draft Resolution clearly states that the criteria for natural area and population size are determined according to Resolution 1211 of 2016 of the National Assembly Standing Committee (amended and supplemented in 2022).

The draft notes that no reorganization should be carried out for administrative units with isolated locations and difficulty in organizing traffic connectivity or administrative units with especially important locations, affecting national defense and security and protecting national sovereignty.

The draft Resolution also sets out the procedures for developing and approving the Project on the arrangement of administrative units at the provincial and commune levels.

Regarding the issue of collecting public opinions on the project to reorganize administrative units, the draft states that the People's Committees at the provincial level are responsible for organizing the collection of public opinions as voters representing permanent households in the area; deciding on the content and form of collecting opinions in accordance with local practical conditions.

Within a maximum of 5 working days from the date of completion of the public consultation, the Provincial People's Committee will organize the synthesis and preparation of a report on the results of the public consultation in the area.
