The National Assembly has passed the Law on Civil Judgment Enforcement. This Law takes effect from July 1, 2026.
This Law clearly stipulates the duties and powers of the People's Committees (PCs) at the provincial and commune levels in enforcing civil judgments.
For the provincial level, state management of the organization and operation of inheritors in the locality will be carried out according to the Government's regulations.
Direct the coordination between relevant agencies in the enforcement of civil judgments in the area, promptly resolve problems and difficulties arising in the coordination between relevant agencies in the enforcement of civil judgments.
Direct the organization of enforcement of major, complicated cases affecting security, social order and safety in localities according to the proposal of the Head of the Civil Judgment Enforcement Agency.
At the same time, the Chairman of the Provincial People's Committee resolved complaints about the appointment, reappointment, and dismissal of Coaching members; registration to practice and issuance of a Coaching Card; temporarily suspending the practice of Coaching.
Establish, register the operation, convert, merge, consolidate, transfer, temporarily suspend the operation, terminate the operation of the civil judgment enforcement office in accordance with the provisions of the law on complaints.
Meanwhile, the People's Committee at the commune level has the task of coordinating with civil enforcement agencies, enforcement officers, and civil enforcement offices in mobilizing and persuading subjects to voluntarily enforce the judgment.
Notice of execution of the judgment, verification of conditions for execution of the judgment, application of measures to ensure, application of enforcement measures for execution of judgments and other tasks on civil judgment enforcement in the area.
In addition, promptly resolve recommendations, problems and difficulties arising in coordination between specialized agencies under the People's Committees at the commune level, organizations and individuals involved in the enforcement of civil judgments in the area; ensure security, order and social safety in the process of organizing the enforcement of judgments according to the provisions of law.
Providing information and conditions for enforcement of judgments at the request of civil enforcement agencies, enforcement agencies, civil enforcement offices, and litigants.
Participate and coordinate in organizing enforcement in the area according to the proposal of civil enforcement agencies and enforcement officers.
Participate in the Council for the destruction of evidence and assets at the request of the civil enforcement agency; receive and handle evidence and assets in the state budget and preserve assets according to the provisions of this Law.
Both provincial and commune People's Committee agencies perform other tasks and powers according to Government regulations.
