It is necessary to comprehensively decentralize and delegate power
This afternoon (April 8), continuing the First Session, the National Assembly discussed in groups about the draft Capital Law (amended).
Giving opinions on the revised Capital Law, Politburo Member, National Assembly Chairman Tran Thanh Man expressed high agreement with the necessity of promulgating the Law.
The National Assembly Chairwoman stated clearly that in 2025, we have promulgated 89 laws, among which there are mechanisms and policies that are far superior to the current Capital Law. Thus, the current Capital Law has become outdated, not keeping up with the amended legal system recently.
Also at the 10th Session, the National Assembly passed Resolution No. 258/2025/QH15 stipulating piloting specific and outstanding mechanisms and policies to implement large projects in Hanoi capital. Similarly, in Ho Chi Minh City, there is Resolution No. 54/2017/QH14 of the National Assembly on piloting specific mechanisms and policies for development.
However, according to the National Assembly Chairwoman, the city still sees that the mechanism is not sufficient for development. Therefore, this revised Capital Law is a prerequisite for the capital to move towards building a special urban law.
Thus, the spirit of amending the Capital Law this time is to decentralize and delegate power comprehensively and to the maximum extent to the Hanoi city government according to the principle that Hanoi decides, Hanoi does, Hanoi takes responsibility" - the National Assembly Chairwoman emphasized.
At the meeting, the National Assembly Chairwoman pointed out 7 highlights of the draft law, which are: expanding the principles of law application; supplementing exemption from legal liability; establishing special administrative-economic units; increasing the authority to organize the apparatus for the City People's Council; increasing the level of administrative penalties; concretizing the suspension of electricity and water supply for handling violations; increasing accountability and transparency.
Emphasizing the direction of General Secretary and President To Lam that Hanoi city must have a 100-year planning vision and look further, National Assembly Chairman Tran Thanh Man said that any country that wants to develop must plan, and planning needs to be announced to the entire people.
In addition, planning needs to go hand in hand with construction deployment, along with compensation, resettlement, and land recovery to build socio-economic projects.
National Assembly Chairman Tran Thanh Man added that it is necessary to protect officials and encourage creativity; urban management tools must be strong; towards a sustainable development model, emphasizing knowledge economy, multi-centered urban areas, linking the Red River region, cultural preservation, in coordination with the orientation "Hanoi: Civilized - Civilized - Modern - Happy".
National Assembly Chairman Tran Thanh Man expressed his wish that at the First Session, according to the simplified process, the Capital Law will be passed and take effect from July 1.
This is a particularly important law, with a strategic vision, showing the high political determination of the Party and State in building a Capital that reaches regional and international levels" - the National Assembly Chairwoman emphasized.
Resolving environmental and traffic pollution
According to the National Assembly Chairwoman, if it is completed in the direction of balancing between strong empowerment, strict control and ensuring transparency, the Capital Law will become an important driving force to help Hanoi solve urgent problems such as traffic congestion, environmental pollution, lack of social housing, and at the same time create breakthroughs in economic development in the coming time.

At the discussion session, delegate Tran Hoang Ngan (Ho Chi Minh City delegation) expressed very high agreement with this draft Law.
Delegate Hoang Ngan said that this is a legal document expressing the Party's viewpoint in the current period of promoting decentralization and delegation of power in the direction of local decision, local action and local responsibility.
This delegate shared that, in terms of practical basis, although there are many legal institutions for the Capital, through management and implementation, the Capital still has many bottlenecks.
Therefore, a truly drastic mechanism is needed for Hanoi to have enough authority to solve bottlenecks in environmental pollution, traffic, flooding...
The requirement is a complete institution, full decentralization and delegation of power for the Capital to handle these issues" - delegate Tran Hoang Ngan said and added that his personal opinion is that he really wants us to decentralize the entire package to the locality.
