Mr. Vu Xuan Hien (Bac Ninh) is an education officer who has received an 18% seniority allowance. In 2021, he was recruited as a civil servant in the Inspectorate and appointed to the position of Principal Inspector.
"So can I transfer my seniority allowance from the Education sector to calculate the seniority allowance for the Inspectorate? And if so, what procedures do I have to follow to receive it?" - Mr. Hien wondered.
Regarding the reflection and recommendation of Mr. Vu Xuan Hien, the Ministry of Home Affairs said: The working time that is counted or not counted for the Inspector's professional allowance has been clearly stipulated in Article 3 of Joint Circular No. 04/2009/TTLT-BNV-BTC dated December 24, 2009 of the Minister of Home Affairs and the Minister of Finance guiding the implementation of the seniority allowance regime for cadres and civil servants whose salaries have been classified according to the ranks or specialized titles of the court, prosecutor, auditor, inspector, civil enforcement and forest rangers.
In Clause 1, Article 3 of the above Circular, it is stipulated that the working time to be calculated for seniority allowance is determined by the following total time:
Working time is classified according to one of the ranks or titles of the customs, court, prosecution, audit, inspection, civil enforcement, forestry, and Party inspection sectors (if there is a period of interruption during which the working time is calculated to receive seniority allowance but has not yet received a one-time social insurance benefit, it will be accumulated);
Working time is entitled to seniority allowance in the army, police and cryptography (if any);
The period of military service as prescribed by law of the subjects specified in Article 1 of this Circular who, before joining the military service, were receiving seniority allowance.
