The Ministry of Home Affairs has completed the draft Law on Organization of Local Government (amended), seeking opinions from agencies before submitting it to the National Assembly for consideration and decision at the 9th session.
The draft clearly stipulates the process of resignation, dismissal, and election of local leadership positions.
Regarding the process of electing positions and draft regulations, the People's Council (PC) elects the Chairman, Vice Chairman, and Head of thePC among the nominated delegates.
At the first session, the People's Council elected these positions according to the proposal of the Standing Committee of the previous People's Council.
In case of the Standing Committee of the provincial People's Council, the National Assembly Standing Committee will appoint the presiding over the meeting. If the Standing Committee of the People's Council at the grassroots level, the Standing Committee of the provincial People's Council appoints the presiding over the meeting.
Meanwhile, the People's Council will elect the Chairman of the People's Committee according to the introduction of the Chairman of the People's Council, the vice president and member of the People's Committee according to the introduction of the Chairman of the People's Committee. The title of Chairman of the People's Committee is not necessarily a representative of the People's Council.
Also according to the draft, during the process of electing positions, if there are candidates or introducing additional candidates from the list, the standing agency will submit to the People's Council for consideration and decision.
At the first session of each term, the session chairman submits to the People's Council for consideration and decision.
Regarding resignation and dismissal, the draft clearly states that elected people who are "due to health reasons" or for other reasons and cannot continue to perform their duties can resign.
In this case, the resignation candidate must submit a petition and send it to the competent authority or person to introduce to the People's Council elected to that position. The time for dismissing the resignation candidate takes place at the most recent session.
