Temporarily maintain the regime for the Commune-level Military Command

The Ministry of Home Affairs proposes that the locality temporarily maintain the current status of the regime and policies for those working at the Commune-level Military Command.

The Ministry of Home Affairs has issued Official Letter 6392 on professional exchanges in the face of difficulties and problems of the Department of Home Affairs of Tay Ninh province.

One of those problems is the cases of candidates who have been admitted to the commune-level civil service recruitment period previously organized by the district-level People's Committees, but have not yet issued a recruitment decision due to the need to implement the temporary suspension policy according to Conclusion No. 128 of the Politburo.

The Ministry of Home Affairs said that on June 27, 2025, the Politburo and the Secretariat issued Conclusion No. 171 on continuing to deploy and complete the task of reorganizing the apparatus and administrative units, in which it concluded: "From July 1, 2025, provincial Party committees, city Party committees, and party committees directly under the Central Government will carry out personnel work according to their authority, ensuring compliance with the regulations of the Party and State (ending the validity of Conclusion No. 128-KL/TW dated March 7, 2025 of the Politburo on personnel work policies)".

Clause 1, Article 70 of Decree No. 170/2025 stipulates: "In case the first round of recruitment process has been completed before the effective date of this Decree, recruitment will continue to be carried out according to the provisions of current law within 3 months from the effective date of this Decree; in case it is not completed within 3 months, the recruitment period will be canceled".

Therefore, for cases that have been recruited during the commune-level civil servant recruitment period implemented by the district-level People's Committee (previously), but have not yet issued a recruitment decision due to the implementation of the recruitment suspension policy according to Conclusion No. 128 of the Politburo, localities need to review the standards, conditions, job positions and actual number of civil servants present compared to the staffing framework of the commune-level government as prescribed in Official Dispatch No.9.

In case of meeting all standards, conditions and still having staffing quotas and recruitment needs according to the requirements of the job position at the commune level (new), consider and decide to continue recruiting civil servants according to authority.

Regarding the classification of senior specialist and specialist for civil servants assigned to positions as civil servants in leadership and management positions, the Ministry of Home Affairs said that in cases where they are holding positions and titles of leadership and management as prescribed in Point a, Point b, Clause 2, Article 70 of Decree No. 170/2025 but have not been classified accordingly, the civil servant-using agency shall report to the competent authority managing civil servants for consideration and classification of the corresponding civil servant rank (not required to have a certificate of training in state management knowledge and skills and meeting the holding period lower than the adjacent rank) as prescribed.

In case the appointment standards and conditions are met, the arrangement corresponding to the position and title shall be carried out simultaneously in the appointment decision.

Regarding the Commune-level Military Command and non-professional workers at the commune level, the Ministry of Home Affairs is currently coordinating with the Ministry of National Defense to guide the recruitment and salary arrangement for Commanders, Deputy Commanders, and Assistants to the Commune-level Military Command (new).

In the immediate future, the Ministry of Home Affairs proposes that the locality temporarily maintain the current status of the regime and policies for those working at the Commune-level Military Command until there are specific instructions from the competent authority.

Regarding the acceptance of non-professional workers as civil servants, it is recommended to do so after the Job Position Project has been approved by competent authorities.
