The Government has just issued Decree No. 109/2025/ND-CP stipulating the functions, tasks, powers and organizational structure of the Government Inspectorate.
This Decree takes effect from January 1, 2025 and accordingly, the Government Inspectorate is a ministerial -level agency of the Government, performing the function of state management of inspection, receiving citizens, settling complaints, denunciations and anti -corruption, negative and negative nationwide; Carrying out the inspection and receiving activities of citizens, settling complaints, denunciations and prevention of corruption, wastefulness and negativity in accordance with the law.
Regarding inspection activities, the Government Inspectorate will build the direction of the inspection program to submit to the Prime Minister for approval; formulating and organizing the implementation of the inspection plan of the Government Inspectorate; Guide the Inspectorate of the Ministry of Defense, the Ministry of Public Security Inspectorate, the State Bank Inspectorate, Cipher Inspection, the Inspection Agency under the International Treaty, the Provincial Inspectorate to develop an inspection and urge and inspection plan for the implementation of the inspection plan.
Inspect the implementation of policies, laws, tasks and powers of ministries, ministerial-level agencies, agencies under the Government, and provincial People's Committees; inspect the implementation of policies, laws, tasks and powers of agencies, organizations, units, and individuals under the management of ministries without a ministerial Inspectorate. ;
Inspect compliance with the law in areas under the state management of ministries without a ministerial Inspectorate; inspect complex cases related to the state management responsibilities of many ministries, ministerial-level agencies, and provincial People's Committees; inspect the management and use of state capital and assets in enterprises; inspect when detecting signs of law violations...
Notably, the inspection of the Ministry of Public Security, the Ministry of Defense Inspectorate, the State Bank Inspectorate and the Cipher Inspectorate ..., the Government Inspectorate will be responsible for checking the accuracy and legality of the inspection conclusions of these agencies and the decision to handle after the inspection of the head of the state management agency of the same level when necessary;
The Government Inspectorate will simultaneously inspect the incident conclusions of inspection of the Ministry of Defense Inspectorate, the Ministry of Public Security Inspectorate, the State Bank Inspectorate, Cipher Inspection, Inspection Agency under international treaties and provincial Inspectors when detecting signs of violations of the law;
Monitor, urge, and inspect the implementation of inspection conclusions of the Government Inspectorate, decisions on handling inspections of the Prime Minister; request ministries, ministerial-level agencies, agencies under the Government, and provincial People's Committees to assign people with expertise and profession to join the Government Inspectorate Inspection Team when necessary.
The Government Inspectorate will also recommend the Prime Minister, competent agencies and organizations, request the heads of agencies and organizations to review responsibilities and handle organizations and individuals under their management who have committed violations of the law discovered through inspection or do not comply with conclusions, recommendations and decisions on handling inspection.
