The Government has just issued Decree No. 367/2025/ND-CP amending and supplementing a number of articles of Decree No. 118/2025/ND-CP on implementing administrative procedures according to the one-stop shop mechanism, inter-agency one-stop shop at the one-stop shop department and the National Public Service Portal.
According to new regulations, the information system for resolving administrative procedures is a unified platform of ministries, branches, and localities, with the function of receiving, resolving, and monitoring the situation of receiving, resolving, and resolving administrative procedures of agencies and units; connecting, integrating, and sharing data with the National Public Service Portal to provide and implement online public services.
Decree No. 367/2025/ND-CP amends regulations related to the organization of the one-stop shop in localities in the direction that the City People's Committee does not decide to establish a single-level Public Administrative Service Center but submits it to the City People's Council for decision.
In cities, based on considering the specific characteristics of population management, urban residential life organization, assessing the level of application of science and technology, innovation and digital transformation in the city, the City People's Committee submits to the City People's Council to decide on the establishment of a provincial-level Public Administration Service Center as an administrative organization directly under the City People's Committee (One-Level Public Administration Service Center) and decide on the number of branches directly under the One-Level Public Administration Service Center to perform tasks within the local scope.
In case this model is not chosen, the City People's Committee decides to establish a provincial-level Public Administration Service Center according to regulations.
Similarly, for commune level, the commune-level People's Committee submits to the commune-level People's Council to decide on the establishment of the Public Administrative Service Center at the commune level, which is an administrative organization under the commune-level People's Committee, with its own seal and account to perform assigned tasks and powers.
Do not organize Public Administrative Service Centers at the commune level under the commune-level People's Committee in localities that choose the model of a single-level Public Administrative Service Center directly under the provincial-level People's Committee.
Regarding the method of organizations and individuals submitting dossiers and receiving results of administrative procedure resolution, Decree 118/2025/ND-CP stipulates 3 methods including: Directly at the one-stop department; Through public postal services, through leasing services from businesses and individuals or through authorization according to the provisions of law; Online at the National Public Service Portal.
In addition to the above methods, Decree No. 367/2025/ND-CP supplements regulations allowing organizations and individuals to submit dossiers and receive results of online administrative procedure resolution at VNeID (National Identification Application).
Decree 367/2025/ND-CP also supplements regulations: The local administrative procedure resolution information system does not receive and resolve administrative procedures that have been provided with online public services according to the centralized model at the administrative procedure resolution information system of ministries and branches.
In this case, the local administrative procedure resolution information system is connected and synchronized with administrative procedure resolution data from the administrative procedure resolution information system of ministries and sectors to look up, exploit, monitor, statistically, summarize, and evaluate the situation of administrative procedure implementation in the locality.
