The Government has just issued Decree 280/2025/ND-CP amending and supplementing a number of articles of Decree 23/2015/ND-CP on granting copies from the original book, certifying copies from the original, certifying signatures and certifying contracts and transactions. Decree 280/2025/ND-CP takes effect from November 1, 2025.
Decree No. 280/2025/ND-CP supplements regulations on the obligations and rights of the person performing the certification: the person performing the certification does not require the person requesting the certification to submit, present the original or a copy of the documents and papers integrated on VNeID when the person requesting the certification has presented the corresponding information from VNeID.
In case the person requesting the certification of the application and the person performing the certification can exploit information and documents from the National Population Database or other databases as prescribed by law, the person performing the certification is responsible for exploiting information and documents from these databases, not requiring the person requesting the certification to present the original, copy of the original book or certified copy of the exploited information and documents.
This Decree also stipulates that with certification of copy from original, certification of signature, certification of transactions related to real estate assets, certification of will, certification of documents refusing to receive inheritance, certification of authorization documents related to the exercise of rights of land users, houses, certification of amendments, supplements, and cancellation of the above transactions, the certification does not depend on the place of residence of the certified person.
Thus, for the above cases, people do not need to go to their place of residence to authenticate but can authenticate their documents and transactions at any commune-level People's Committee.
According to Decree 280/2025/ND-CP, the Chairman of the People's Committee at the commune level has the authority and responsibility to:
- Certify the original of documents and papers issued or certified by competent Vietnamese agencies and organizations; competent foreign agencies and organizations; competent Vietnamese agencies and organizations affiliated with competent foreign agencies and organizations;
- Certify the signature in documents and papers;
- Certificate the signature of the translator in documents and papers from foreign languages to Vietnamese, from Vietnamese to foreign languages;
- Certificate of transactions related to real estate assets;
- Certificate of transactions related to land users' rights according to the provisions of the law on land;
- Certificate housing transactions according to the provisions of the law on housing;
- test of will;
- Certificate the document of refusal to receive the inheritance;
- Certificate the above-mentioned documents on dividing inheritance as real estate, transactions related to the rights of land users, and housing transactions.
The Chairman of the People's Committee at the commune level directs and organizes the implementation of the above certification activities in the area.
The authorization and assignment of certification and the signing and use of seals when performing certification are carried out in accordance with the provisions of law on the organization of local government, the law on the organization of specialized agencies under the People's Committee at the commune level and relevant laws.
