Mr. Nguyen Van C was recruited to work at the State Treasury of District A (district name has been changed), Binh Dinh province since October 2010. This unit is an agency located in a particularly difficult area.
In November 2020, Mr. C was transferred to work at the State Treasury in District B (the district name has been changed). In September 2024, Mr. C was transferred back to the State Treasury in District A (still in a particularly difficult area).
Currently, Mr. C has not yet received the first subsidy under Decree 116/2010/ND-CP, now replaced by Decree 76/2019/ND-CP. "So, according to Decree 76/2019/ND-CP, am I eligible to receive the first subsidy?" - Mr. C wondered.
Regarding the reflection and recommendation of Mr. Nguyen Van C, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Accordingly, the first allowance when accepting a job in an area with particularly difficult socio-economic conditions has been stipulated in Decree No. 116/2010/ND-CP dated October 24, 2010 of the Government (from December 1, 2019, it will be implemented according to the provisions of Article 6 of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government).
Subjects specified in Article 2 of this Decree, when first assigned to work at agencies, organizations and units in areas with particularly difficult socio-economic conditions, shall enjoy the following allowances:
1. The first allowance is equal to 10 months of basic salary at the time of taking up work in an area with particularly difficult socio-economic conditions.
2. In case a family member comes to work in an area with particularly difficult socio-economic conditions, in addition to the initial allowance, they will also receive the following allowances:
a) Train and luggage fees for family members traveling together are calculated based on the actual ticket price or fare of public transport or paid at a fixed rate based on the actual number of kilometers traveled multiplied by the unit price of regular public transport (train, boat, passenger car);
b) Subsidize 12 months of basic salary for households.
3. The allowances prescribed in Clauses 1 and 2 of this Article shall be paid by the agencies, organizations and units in areas with particularly difficult socio-economic conditions where the recipient is assigned to work as soon as the beneficiary receives the work and shall be paid only once during the total actual working time in areas with particularly difficult socio-economic conditions.
In case cadres, civil servants and public employees are still working in areas with particularly difficult socio-economic conditions and have not yet received the first allowance as prescribed in Article 6 of Decree 116/2010/ND-CP, from December 1, 2019, the first allowance will be implemented as prescribed in Article 6 of Decree No. 76/2019/ND-CP of the Government.
The implementation of regimes and policies for cadres, civil servants, public employees and workers in Binh Dinh province is under the authority of the Provincial People's Committee.
