Ms. Nguyen Thi Huyen (Ba Vi, Hanoi) learned that Circular No. 79/2005 stipulates in Point c, Clause 5 and Point c, Clause 10 of Section III on salary transfer methods, which stipulates that the reserve coefficient is reduced accordingly when cadres, civil servants, and public employees are promoted or receive seniority allowances beyond the framework in the appointed or promoted grade.
Ms. Huyen said that in Circular No. 02/2007 dated May 25, 2007 on instructions for salary classification when upgrading, transferring ranks, and transferring types of civil servants and public employees, Clause 5, Section 3 was abolished, meaning that the reserved difference coefficient is no longer deducted.
Currently, the reserved difference is reduced accordingly only at point c, clause 10 of Circular 79/2005, applicable to subjects whose salaries are classified according to the salary scale of workers, direct production employees and state-owned enterprises.
"Why is there this distinction and is it appropriate or does it need to be changed?" - Ms. Huyen wondered.
Regarding the reflection and recommendation of Ms. Nguyen Thi Huyen, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Salary arrangement when promoting civil servants and public employees is regulated in Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding salary arrangement when promoting, transferring ranks, and transferring types of civil servants and public employees, which provides guidance for each specific case.
Clause 10 of Circular No. 79/2005/TT-BNV dated August 10, 2005 of the Minister of Home Affairs only applies to subjects whose salaries are arranged according to salary scales, salary tables for workers, direct production and business employees, salary tables for senior experts and artisans in State-owned companies who are transferred to work in State agencies and State-owned public service units.
The organization and implementation of policies for cadres, civil servants and public employees in Hanoi city is under the authority of the City People's Committee.
