The Ministry of Public Security has just issued Circular No. 03/2025/TT-BCA regulating the health rehabilitation care regime in the People's Public Security.
Accordingly, this Circular stipulates the subjects and principles; cases where health rehabilitation care is implemented and not implemented; time, form, regime and content of health rehabilitation care expenditure; means of transportation;
Authority, order, procedures, and documents for requesting health rehabilitation care benefits; implementation costs and responsibilities of agencies and organizations related to the implementation of health rehabilitation care benefits in the People's Public Security.
The implementation of the health rehabilitation care regime in the People's Public Security must comply with the provisions of this Circular and other provisions of law.
Notably, the Circular clearly states the time for nursing to recover health.
Level 1 maximum 10 days
For officers and soldiers whose health has not recovered from a period of illness due to a long-term illness that requires treatment; officers and soldiers born once with two or more children;
Officers and soldiers with a working capacity reduction of 51% or more due to work-related accidents or occupational diseases after stable treatment for disability due to work-related accidents or diseases due to occupational diseases but whose health has not recovered;
Officers and soldiers working, fighting, and laboring are on the list of particularly arduous, toxic, and dangerous occupations and jobs according to the regulations of the Ministry of Labor, War Invalids and Social Affairs.
Level 2 maximum 7 days
For officers and soldiers whose health has not recovered from a period of illness due to surgery; officers and soldiers whose children have to undergo surgery;
Officers and soldiers with a reduction in working capacity of 31% to 50% due to work-related accidents or occupational diseases after stable treatment for disability due to work-related accidents or diseases due to occupational diseases but whose health has not recovered;
Officers and soldiers working, fighting, and laboring are on the list of arduous, toxic, and dangerous occupations and jobs according to the regulations of the Ministry of Labor, War Invalids and Social Affairs.
Level 3 maximum 5 days
For other maternity cases that are entitled to maternity benefits according to the provisions of the Law on Social Insurance No. 58/2014/QH13, within the first 30 working days, their health has not recovered;
Officers and soldiers with a reduction in working capacity of 15% to 30% due to work-related accidents or occupational diseases after stable treatment for disability due to work-related accidents or diseases due to occupational diseases but whose health has not recovered;
Officers and soldiers who have not recovered from a period of illness and are being treated at medical examination and treatment facilities;
Officials and soldiers with health grade IV, V or type C, D specified in Point d, Clause 10, Article 16 of Circular No. 62/2023/TT-BCA; officers and soldiers with poor health due to prolonged stress work and prolonged treatment of chronic diseases.
The nursing care time includes holidays, Tet holidays, and weekly days off.
