On behalf of the Politburo, Politburo Member, Standing Secretary of the Secretariat Tran Cam Tu signed and issued Conclusion No. 09-KL/TW dated March 10, 2026 on completing the structure of the Vietnamese legal system to meet the requirements of national development in the new era.
Accordingly, to create a solid legal foundation to promote continuous economic growth of over 10% annually, making Vietnam a developed country with high income in a socialist orientation by 2045, it is necessary to research and improve the structure of the Vietnamese legal system.
Conclusion No. 09-KL/TW clearly states that the completion of the legal system structure needs to ensure orientations.
In which, the structure of the legal system is determined in order from legal sources, including the system of legal normative documents (Constitution; legal normative documents of the National Assembly and the National Assembly Standing Committee; legal normative documents under the law of central agencies; legal normative documents of local authorities) and supplementary sources ( precedents, customs, fairness).
The conclusion also stated the requirement to clearly define public legal norms and private legal norms in law-making.
Strictly implementing the principle of "respecting the Constitution and law", the Constitution is the basic law with the highest legal validity; a number of basic laws are the center of the legal system, including: Civil Code, Penal Code, Civil Procedure Code, Criminal Procedure Code, Administrative Procedure Code. Among the basic legal documents, in addition to detailed and specific regulations, there are also basic principles that have the value of governing and orienting the remaining legal documents in the legal system.
Promote the completion of legal regulations to serve development, promote the leading role, "go ahead to pave the way" of law, and make institutions and laws a competitive advantage.
Focus on issuing specific policies and controlled testing mechanisms to form new production forces, production methods, and economic sectors and encourage and promote the development of industries, occupations, localities, and groups of subjects identified as priority development.
The conclusion also stated the direction, conducting a general review of the system of legal normative documents of Vietnam; absolutely not allowing interests to be planted, negatively impacting the structure of the legal system; strongly innovating the consolidation of legal normative documents in the direction that consolidated documents are the official basis in citing and applying laws, and are submitted and published simultaneously with amended and supplemented legal normative documents.
Improve the mechanism for interpreting the Constitution, laws, ordinances and the guiding mechanism for applying legal normative documents in the direction of clearly defining competent subjects, principles, processes of interpretation and application guidance.
Research mechanisms to accelerate the institutionalization of the Party's guidelines and orientations into law. Continue to innovate the organization and operation of the National Assembly in legislative activities in the direction of reasonably increasing the number of National Assembly sessions, especially through online forms, associated with promoting the role of full-time National Assembly deputies and National Assembly delegations.
On the basis of complying with the Constitution and international treaties to which the Socialist Republic of Vietnam is a member, respecting, protecting and ensuring human rights and citizens' rights, study a mechanism to allow the National Assembly Standing Committee and the Government to issue documents adjusting legal regulations in urgent and emergency cases where the National Assembly cannot hold a meeting or adjust technical contents to immediately resolve some issues arising in practice, and report to the National Assembly at the nearest session.
