Civil servants with 5 years of service are considered for recruitment into civil service

The Ministry of Home Affairs has just issued specific guidance on the conditions for being accepted into civil service for public employees who have a university degree and 5 years of work experience.

Mr. Trinh Van Bang (name of the character changed) is an official working at a public non-business unit, with a recruitment decision dated June 1, 2020. To date, he has worked continuously for 5 years and 6 months.

From the above reality, Mr. Bang requested competent authorities to consider and give opinions on whether his case is eligible to be recruited as a civil servant according to point b, clause 3, Article 13 of Decree No. 170/2025/ND-CP or not.

Regarding the reflection and recommendation of Mr. Bang, the Ministry of Home Affairs has responded on the Electronic Information Portal.

Clause 3, Article 13 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants, stipulates: "Based on the proportion of civil servants to be arranged according to each job position in the agency using civil servants, assigned staff quotas and requirements of the job position to be recruited, the head of the competent recruitment agency or the head of the management agency shall consider and receive them to become civil servants for the cases specified in Clause 1 of this Article if they meet the conditions for registering for civil servant recruitment specified in Clause 1, Article 19 of the Law on Cadres and Civil Servants, except for the cases specified in Clause 3, Article 19 of the Law on Cadres and Civil Servants or during the period of disciplinary action, during the period of enforcement of disciplinary decisions, during the period of implementation of regulations related to discipline according to the Party's regulations, and the law.

In cases specified in points b, c, d, e, g and h, clause 1 of this Article, they must have worked for 5 years or more in accordance with the law, have paid compulsory social insurance (if not continuously and have not received a one-time social insurance allowance, they are accumulated, including working time if they were previously in the job position specified in points b, c, d, d, e, g and h, clause 1 of this Article), do jobs with professional and nghiep vu requirements suitable for the job position expected to be received.

Based on the provisions of Article 67 of Decree No. 170/2025/ND-CP, the Ministry of Home Affairs requests you to contact the competent authority for recruiting civil servants of the job position to apply for a job to be resolved.
