On November 11, the National Assembly discussed in the hall the draft Law on Civil Judgment Enforcement (amended); the draft Law on Judicial Assessment (amended).
Speaking to clarify some issues of concern to delegates, Minister of Justice Nguyen Hai Ninh said that delegates had many opinions on the model of organizing the civil judgment enforcement system (THADS).
After 4 months of operation, the Minister of Justice affirmed that there are no problems in coordinating between the investigation agency and the People's Procuracy (KSND) and the People's Court (TAND).
"However, when we rearrange, of course there will be some inadequacies in the first step. However, the general trend, trend and policy are very correct.
After 4 months of operation, the initial difficulties have been overcome. In particular, the project on the system of administrative procedures has been reported to the Government Standing Committee twice and reported to the Politburo twice.
The draft accompanying the conclusion of the Politburo clearly states the organizational model, functions, tasks, advantages, disadvantages and solutions to overcome shortcomings and limitations" - the Minister said.

According to the Minister, the regional legal examination and supervision agency has been placed similarly and agreed with 355 People's Courts and the regional People's Procuracy. In which, there is a unified number, scope, authority of operation, location of headquarters and similar names.
Currently, there is no regional investigation agency, however, the Minister said that it is still coordinating very closely. Although there is currently no regional legal basis, there is still a regional legal basis department, ensuring good authority in judicial activities and coordination with litigation agencies.
Firstly, after 4 months of operation, the targets assigned by the National Assembly for the number of cases and the amount of money have all exceeded, although the absolute number is very large, especially cases and major cases such as Tan Hoang Minh and Van Thinh Phat have all exceeded.
Second, the organization and operation of the THADS system and the methods of operation have been comprehensively changed towards strong, digital transformation.
Currently, a series of software for issuing execution decisions and electronic receipt software are being deployed. Of which, 75,455 execution decisions were made on software, not on paper; issued over 375,000 electronic records and equivalent to VND 33,700 billion.
The Ministry is continuing to build software to organize enforcement to carry out all enforcement activities in the electronic environment and build digital platforms.
The Minister said that recently, the Van Thinh Phat case only needed one button to have more than VND 8,800 billion sent to the accounts of more than 40,000 bondholders. Previously, with more than 40,000 bondholders needing 40,000 copies of documents to each location, when changing digital transformation, this has helped change all activities of the regional commercial bank's operating method.
According to the Minister, in the draft law, the head of the civil judgment enforcement agency is not only an administrative title but a judicial title, the chief enforcement officer.
The revised Law on Administrative Procedure has cut up to 80% of administrative procedures, the remaining 20% is being simplified and will actually be cut.
It is expected to reduce 30% in time and 13% in compliance costs calculated on a case with full legal procedures arising. This can be weighed, measured, weighed, and counted immediately.
