Determine roadmaps and instructions for arranging and reorganizing villages and residential groups

The Ministry of Home Affairs is responsible for determining a roadmap, guiding the arrangement and reorganization of villages and residential groups in the direction of streamlining and improving self-management.

Deputy Prime Minister Nguyen Hoa Binh has just signed and issued Decision No. 1581/QD-TTg of the Prime Minister promulgating the Plan to continue perfecting the organization of the political system and preparing for Party Congresses at all levels.

The plan clearly states a series of specific tasks, identifying the host agency, coordinating agency, products and deadlines for completion.

In particular, the Ministry of Home Affairs coordinates with relevant ministries and branches to determine roadmaps, guide the arrangement and reorganization of villages and residential groups in the direction of streamlining, improving self-management, directly serving the lives of communities in the grassroots area.

The Ministry of Home Affairs shall submit to the Government for promulgation a Decree on the organization and operation of villages and residential groups before May 31, 2026.

Most recently, the People's Committee of Hai Phong City has given its opinion on the unification of the name of self-managed organizations of residential groups in communes, wards, and areas in the city.

Accordingly, the organization under the commune or special zone is a village; the organization under the ward is a residential group.

Regarding the conversion order, the People's Committees of communes, wards, and especially areas must compile a list of villages, residential areas, and residential groups that need to be converted and submit to the People's Councils at the same level for consideration and decision on conversion.

For villages and residential groups with similar names, the People's Committees of communes, wards and special areas will develop a plan to change the name (for villages and residential groups in the same commune-level area with similar names); at the same time, organize the collection of voters' opinions on representative families in villages and residential groups.

If more than 50% of voters representing the family agree, the People's Committee of the commune, ward, or area will complete the plan and submit it to the People's Council at the same level for consideration and decision. For residential areas in wards of Hai Duong province before the merger, it will be implemented simultaneously with the conversion of residential areas into residential groups or villages.

Previously, in Official Dispatch 4168, the Ministry of Home Affairs had specific instructions on this content, in which it was necessary to temporarily keep the villages and residential groups in the commune-level administrative units (new) until there are new regulations from the Government.

The determination of the type of community organization for residents in commune-level units (new) is carried out in accordance with the provisions of the Law on Implementing Democracy at the Grassroots Level.

Accordingly, the organization of villages and residential groups is implemented as follows:

The village is organized in communes and special zones (under communes and special zones, it is a village); Residential groups are organized in wards (under wards, it is a residential group).

In case the special zone is recognized as an urban type according to the provisions of law (special to Phu Quoc area), the residential group is below the special zone.

In case of merging and adjusting communes and towns with wards to establish wards (new): Organize the unification of residential groups in the wards (new).

In case of merging and adjusting towns with communes to establish communes (new): Organize the consolidation of villages in communes (new).

The Ministry of Home Affairs clearly stated that the Law on Organization of Local Government stipulates that the People's Councils at the commune level have the authority to establish, reorganize, dissolve, rename and change the names of villages and residential groups.

On that basis, the conversion of villages and residential groups and the renaming of villages and residential groups due to the same name at the newly formed commune-level unit after the arrangement are implemented as follows:

For the conversion of villages into residential groups or residential groups into villages: The People's Committee of the commune (new) shall make a list of villages that need to be converted into residential groups or a list of residential groups that need to be converted into villages and submit it to the People's Council of the same level for consideration and decision.

Regarding the change of village and residential group names due to the same name: The People's Committee at the commune level (new) will develop a plan, collect opinions from voters who are representatives of households in the village and residential group. If more than 50% of voters representing households agree, the People's Committee at the commune level will complete the plan and submit it to the People's Council at the commune level for consideration and decision.
