The Resolution stipulates the handling of a number of issues related to the arrangement of the state apparatus, including: handling principles; changing the names of agencies, organizations, units, and competent titles; performing the functions, tasks, and powers of competent agencies and titles according to the provisions of law, international treaties, international agreements, and handling a number of other issues when implementing the arrangement of the state apparatus.
This Resolution is applied to the arrangement of the state apparatus in cases of establishment and reorganization (including the arrangement and consolidation of the organizations of agencies in the form of division, separation, merger, consolidation, conversion or adjustment of functions, tasks, and powers), changing the name, changing the model, organizational structure, and dissolving the agency to implement the Party's policy on continuing to innovate and reorganize the apparatus of the political system to be streamlined and operate effectively and efficiently.
The issues handled under this resolution are issues arising in the process of arranging the state apparatus with other contents or not yet stipulated in legal documents (except the Constitution), administrative documents and other forms of documents that are still in effect at the time of implementing the state apparatus arrangement.
The Resolution clearly states: When implementing the arrangement of the state apparatus, the names of the competent agencies and titles specified in the documents are converted according to the names of the agencies and titles receiving those functions, tasks and powers. The competent authority or title that has changed after the arrangement of the state apparatus organization is allowed to use the seal, carry out the procedure for registering the seal model, and hand over the seal according to the provisions of law.
Regarding the implementation of administrative procedures, in case there are changes in the competent authority or title to perform administrative procedures after the arrangement of the state apparatus, the competent authority or person announcing the administrative procedure must immediately make adjustments and announce the adjusted administrative procedures according to the provisions of law.
The competent authority or title receiving the functions, tasks and powers to carry out administrative procedures is responsible for: Organizing the implementation of administrative procedures to ensure smoothness and without interruption; not requiring individuals or organizations to submit submitted documents; not repeating the steps in the administrative procedures that were carried out before the arrangement... This Resolution takes effect from February 19, 2025.
