Circular No. 82/2025/TT-NHNN regulates the gold status of credit institutions allowed to produce gold bars, trade in buying and selling gold bars; trading activities of buying and selling gold bars, buying and selling spot gold materials. The Circular takes effect from February 12, 2026.
In which, the gold status of credit institutions is the balance of gold bars and raw gold arising from gold bar production activities; trading in buying and selling gold bars; buying and selling raw gold materials; exporting gold bars, importing gold bars; importing raw gold materials of credit institutions converted into Vietnamese Dong according to the exchange rate of gold.
In Article 4 of this Circular, the State Bank of Vietnam (SBV) clearly states the limits of gold status.
For credit institutions allowed to produce gold bars, the gold status at the end of the day must not exceed 5% of the equity.
For credit institutions allowed to trade in buying and selling gold bars, except for credit institutions allowed to produce gold bars, the gold status at the end of the day must not exceed 2% compared to the equity.
This new regulation is higher and more specific than before when the gold status of credit institutions was 2% of equity.
Own capital for calculating the gold status limit is the own capital of the month immediately preceding the reporting period of the credit institution, determined according to the SBV's regulations on the ratio of safety assurance in the operation of the credit institution.
In addition, Circular No. 82 requires credit institutions not to maintain a negative gold status.
In necessary cases, credit institutions are allowed to maintain other gold status limits as prescribed above when approved by the SBV Governor.
Notably, to ensure management, no later than 2 pm on the working day, credit institutions must send the gold status report of the immediately preceding working day to the State Bank of Vietnam (Department of Foreign Exchange Management).
