The Lao Dong Newspaper Legal Consulting Office replied:
Clause 3, Article 109, Decree 102/2024/ND-CP detailing the implementation of a number of articles of the Land Law stipulates violations of regulations on land recovery, compensation, support, and resettlement, including the following acts:
a) Land recovery not in accordance with the cases prescribed in Articles 78, 79, 81 and 82 of the Land Law;
b) Land reclamation for national defense and security purposes; socio-economic development for national and public interests is not on the right basis and does not meet the prescribed conditions;
c) Not notifying the person whose land is recovered in advance according to regulations; not properly implementing the procedures for land recovery, compensation, support, and resettlement according to the provisions of the Land Law;
d) Land reclamation without proper authority; not to the right subjects;
d) Compensation, support, and resettlement for the wrong subjects, land areas, compensation, support, and resettlement levels for people whose land is recovered; distort land recovery records; determine the correct location and area of recovered land on site;
e) Enforcement of the implementation of the decision on compulsory inventory, enforcement of the decision to reclaim land that is not in accordance with principles, not meeting conditions; issuance of the decision on enforcement without proper authority; order and procedures for implementing the decision on enforcement are not in accordance with regulations and do not properly perform their responsibilities in implementing the decision on enforcement of land recovery.
Thus, violations of regulations on land recovery, compensation, support, and resettlement are regulated as above.
