Clause 3, Article 31 of the 2023 Identity Card Law stipulates: Electronic ID cards are used to carry out administrative procedures, public services, transactions and other activities according to the needs of citizens.
Article 33 of the 2023 Identity Card Law stipulates the validity of electronic ID cards as follows:
1. Electronic identification cards have the value of proving identity and other information that has been integrated into the electronic identification card of the person granted the electronic identification card to carry out administrative procedures, public services, transactions and other activities according to the needs of citizens.
2. In the process of resolving administrative procedures, public services, performing transactions and other activities, if there is a difference between the information printed on the ID card or the information stored in the encrypted storage part of the ID card and the information in the electronic ID card, the agency, organization, or individual shall use the information in the electronic ID card.
Clause 6, Article 9, Decree 69/2024/ND-CP stipulates electronic identification and authentication as follows: Information on electronic identity and integrated information on electronic identification cards, electronic identification accounts have evidentiary value, equivalent to providing information or using, presenting documents containing that information in performing administrative procedures, public services, transactions and other activities.
Article 28 of Decree 69/2024/ND-CP stipulates the issuance of electronic ID cards as follows:
1. Electronic ID cards are displayed as a feature, utility of the National Identification Application (VNeID) through access to citizens' electronic identification accounts.
2. Electronic ID cards are issued together with the issuance of level 02 electronic identification accounts to Vietnamese citizens and are implemented according to the order and procedures specified in Article 10 of this Decree.
3. The use of electronic ID cards through accessing level 02 electronic identification accounts of citizens has equivalent value to the use of citizen ID cards, valid ID cards in the implementation of administrative procedures, public services, transactions and other activities.
4. Electronic identification cards are permanently stored in the electronic identification and authentication system. Historical information about the use of electronic identification cards is stored in the electronic identification and authentication system for a period of 05 years from the time of use.
5. The Minister of Public Security stipulates the form of expression of electronic ID cards on the National Identification Application.
Thus, the use of electronic ID cards through accessing level 02 electronic identification accounts of citizens has equivalent value to the use of citizen ID cards, valid ID cards in the implementation of administrative procedures, public services, transactions and other activities.
